EXHIf" <br />Amendment to Chapter 1139 (General Retail Business District) <br />1139.01 GENER.AL RETAIL BUSINESS DISTRICT. <br />Proposed (1-23-08) <br />(a) Intent. For the purposes of the Zoning Code, General Retail Business Districts are hereby <br />established to meet the shopping, convenience and service needs of the residents of the <br />entire community and shall be established in a manner to protect adj acent residential <br />neighborhoods by regulating the types of business uses, which could create hazards, <br />noise, odors or other objectionable influences. <br />(b) Permitted Buildings and Uses. In a General Retail Business District, land may be used <br />and buildings may be designed, built, altered or used only for one or more of the <br />following permitted uses. <br />(1) Any use permitted in the least restrictive Residence District adjacent to any part <br />of such General Retail Business District subject to the requirements of such <br />Residence District. <br />(2) Single family cluster dwellings as regulated in Chapter 1136. <br />(3) Retail business. <br />A. The retail sale of baked goods, confectionery, dairy products, delicatessen, <br />fruits, vegetables, groceries, meats and beverages; <br />B. The sale of dry goods and variety merchandise; <br />C. The sale of hardware, household appliances, television and radio, paint, <br />wallpaper, materials and objects for interior decorating; <br />D. The sale of books, magazines, newspapers, tobacco products, drugs, <br />flowers, gifts, music, photographic equipment, sporting goods and <br />stationery; <br />E. The sale of food and beverages of all kinds including sale for consumption <br />on the premises, provided, however, no establishment engaged in the <br />business of selling spirituous, vinous or malt beverages shall be located <br />nearer than 500 feet from the lot occupied by an existing church, public or <br />private school, playground, park, library or public building; <br />F. The retail sale of general merchandise including sales in a department <br />store; <br />G. The retail sale of apparel of all kinds; <br />H. The retail sale of furniture, china, floor coverings and household goods; <br />1. Automobile supply stores, automobile showrooms and lots for the sale of <br />new motor vehicles; in addition, show rooms and lots for the sale of used <br />cars are permitted accessory uses in this district, provided that such <br />accessory uses shall be located either on a parcel of land upon which is <br />located an existing automobile show room and lot for the sale of new <br />motor vehicles, or upon a parcel of land which is physically contiguous to <br />a parcel of land containing an existing automobile show room and lot for <br />the sale of new motor vehicles; <br />J. The retail sale of motor vehicle fuel provided that no alcoholic beverages <br />are dispensed or sold on the same lot; and
