Any funds which are in excess of the City's cost of grading <br />shall be returned to the individual making the deposit as aforesaid; and further, any <br />deficiency in funds between the deposit and the cost of the City doing the grading shall <br />become a lien upon the lands and shall be certified to the Auditor of the County for <br />entering upon the tax duplicate and collection as other taxes and shall be returned by <br />the Auditor of the County to the City for deposit in the General Fund of the City. <br />SECTION 2: That the original Section 931.10 of the Streets, Utilities and Public <br />Services Code amended herein is expressly repealed, and all other ordinances or <br />resolutions, or parts of ordinances or resolutions, that are inconsistent or in conflict with <br />new section 931.10 of the said Code, are likewise repealed to the extent of such <br />inconsistency or conflict only. <br />SECTION 3: That this Ordinance shall take effect and be in force from and after <br />the earliest period allowed by law. <br />3 <br />
