<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 - 37 <br />BY: Mayor O'Grady <br />AN ORDINANCE PROVIDING FOR THE AMENDMENT OF <br />THE ZONE MAP OF THE CITY OF NORTH OLMSTED IN <br />ORDER TO SUPPLEMENTALLY ZONE PERMANENT <br />PARCEL NUMBER 233-I1-012 SO AS TO INCLUDE IT <br />WITHIN THE WIRELESS TELECOMMUNICATION <br />FACILITIES OVERLAY ("WTFO ") DISTRICT, CHAPTER <br />1151, OF THE CITY OF NORTH OLMSTED. <br />WHEREAS, this Council has been requested by T-Mobile and the owners of property <br />now used and known as Patton's Towing to review the Zone Map of the City of North Olmsted in <br />order to consider the parcel of real property which, by reason of its size, location and distance <br />from residential structures, may be deemed suitable for locating wireless telecommunication <br />facilities upon, pursuant to the provisions of Chapter 1151 of the Zoning Code, entitled "Wireless <br />Telecommunication Facilities Regulations and Wireless Telecommunications Facilities Overlay <br />(WTFO) District; and <br />WHEREAS, this Council desires to amend the Zone Map of the City of North Olmsted in <br />order to supplementally zone the aforesaid parcel of real property for inclusion within the WTFO <br />district created by said Chapter 1151 of the Zoning Code, and as such cell tower use is propwed <br />to be located at and limited to the northern portion of the land utilized by Patton's Towing and <br />surrounding parking and wooded areas; and <br />WHEREAS, the Council, upon careful review and deliberate consideration has determined <br />that the supplemental zoning of the said parcel of real property, which are identified in the <br />attached map labeled Exhibit A, for inclusion within the said overlay district represents a sound <br />planning decision and is not likely to have adverse economic impact upon the owners of said <br />properties, or upon neighboring properties; and <br />WHEREAS, this Council has determined that, although the overlay district did not exist at <br />the time that the City's Master Plan was initially established, the proposed supplemental zoning of <br />these parcels for inclusion within the overlay district created by Chapter 1151 of the Zoning Code <br />will not be inconsistent with the City's Master Plan for the involved areas of the City, and will in <br />fact promote the health, welfare and safety of the residents in this area of this City; and <br />WHEREAS, the Planning Commission on? ., 2008, by formal <br />motion, (recommended - did not recommend) that this Ordinance, supplementally zoning the said <br />parcels of land for inclusion within the WTFO district, be approved; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That, after submission of this Ordinance to the Planning Commission of this <br />City for its opinion and recommendation, and after a Public Hearing hereon, notice of which has <br />been given pursuant to Section 14 of Article IV of the Charter of the City, entitled, "The Council- <br />Enactment of Zoning Ordinance and Regulations, Notice", and after its passage pursuant to the <br />
