C. STC transit buses vehicles will accord the "right-of way" to City public <br />safety and service vehicles especially in t11e case of an emei-gency oi- <br />urgent necessity. <br />4. At the end of each month, the City will invoice STC for motor fi?el(s) pumped during <br />the preceding month. Pursuant to the current standard, the monthly invoicing will <br />include individual vehicle consumption levels, costs by vehicle, type of fuel and a <br />cost/invoice cover sheet showing the summary total(s) for the month. <br />5. The monthly charge for motor fuel will be based on the unit cost of the fLiel plus (+) <br />the fLiel tax as levied by the State of Ohio. In addition, the City of North Olmsted will <br />levy aS.20 per gallon service fee to be paid by STC. <br />6. STC is and shall reinain responsible foi- maintenance of doctunentation to support tax <br />exempt status of transit buses aizd shall not fuel non exempt vehicles at City facilities. <br />STC will maintain ai-id supply the City with cutrent and up-to-date Federal Excise <br />Tax exemption certificates. <br />7. Eithei- party may apply for one cost adjustment in fLiel in any twelve (12) month <br />period after this Agreement has been in effect for twelve (12) months. The i-equest <br />must be in writing witl1 justifications to the other party's assigned Administrator. <br />Both parties governing body must approve any modification to the Agreement. <br />8. Once approved by both entities, the implementation of the terms of this Agreement <br />shall be assigned to the assigned Administrator as deemed appropriate by each entity. <br />9. The term of this Contract shall be for 24 month period commencing on the date of <br />execution of this agreement. <br />10.
