CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 - 44 <br />BY: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTIONS 1351.99, 1363.07, 1363.08, <br />1363.10 AND 1363.99 OF THE PROPERTY NUMBERS AND REAL <br />PROPERTY MAINTENANCE CHAPTERS IN ORDER TO <br />PROMOTE EFFICIENCY, CLARIFY WHEN SEARCH WARRANTS <br />ARE REQUIRED AND INCREASE THE PENALTIES FOR <br />PROPERTY MAINTENANCE VIOLATIONS; AND DECLARING AN <br />EMERGENCY, AS TWICE AMENDED. <br />WHEREAS, it is in the interest of North Olmsted residents to ensure that all <br />owners of real property maintain their property in a rnanner designed to preserve the <br />value and appearance of the City's residential and commercial building stock and <br />displav visible addresses; and, <br />WHEREAS, Chapter 1363 of the Building Code, and specifically Section <br />1363.07, set forth standards for the maintenance of buildings and real property located in <br />the City of North Olmsted; and <br />WHEREAS, Section 1363.08 of the Code permits an appeal of a notice of <br />violation issued by the Real Property Maintenance Officer to the Board of Building Code <br />Appeals; and <br />WHEREAS, Section 1363.08 of the Code states that it is an offense under the <br />Code to refuse to permit the Real Property Maintenance Officer to conduct an inspection <br />of a building located within the City; and <br />WHEREAS, Section 1363.10 permits the Property Maintenance Officer to vary or <br />modify provisions of the Code; and <br />WHEREAS, Section 1363.99 currently provides that all violations of the Code <br />are minor misdemeanors; and <br />WHEREAS Chapter 1351 requires all owners, agents and occupants of real <br />propertv to display address numbers that are capable of beine seen from the <br />opnosite side of the street; and,
