CITY OF NOl2TH OLMSTED <br />RESOLUTION NO. 2008 - 46 <br />By: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO, ON BEHALF <br />OF THE CITY OF NORTH OLMSTED, AND TO CERTIFY ADOPTION OF A <br />JOINT ECONOMIC DEVELOPMENT ZONE (JEDZ) AGREEMENT WITH THE <br />CITYOFAVON, OHIO. <br />WHEREAS, on December 1, 2006, the City of Avon requested that the Northeast Ohio Areawide <br />Coordinating Agency (NOACA) to amend its Transportation Plan to include the recommendations of the <br />Avon Access Study that include a new interchangc on Interstate 90 at Nagel Road, widening of seleeted <br />arterial and collector streets within Avon and intersection improvements on State Route 83; and <br />WHEREAS, on October 12, 2007 the Governing Boardl of NOACA adopted Resolution No. <br />2007-035 approving the Transportation Plan amendment; and <br />WHEREAS, on February 12, 2008, the Cities of Cleveland and Avon created a Joint Economic <br />Developn7ent Zone (JEDZ) Agreement and invite surrounding cities to join within 180 days: and <br />WHEREAS, JEDZ parties desire to worlc toward a regional economy focused on growth, <br />innovation, and cooperative efforts, rather than corxipetition aniongst governmental neighbors within <br />Cuyahoga County and Lorain County; and <br />WHEREAS, JEDZ parties intend to enter into an Agreement to create and provide for the <br />operation of a joint economic development zone in accordance with Section 715.69 of the Revised Code, <br />for the purpose of facilitating new or expanded growth far commercial or economic development for the <br />benefit of their residents and of the State: and <br />WHEREAS, the JEDZ Agreement provides in part that, iri consideration of the City's support <br />and advocacy for roadway improvements, the Ciry of Avon commits to certain limitations on tax <br />abatement and other income tax sharing with City members of the JEDZ; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE C'OUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authomized to enter into, on behalf of the City <br />of North Olmsted, a Joint Economic Development Zone (J]---DZ) Agreement and to execute the <br />Certification of Adoption thereof, all of which will be in accordance with the Agreement which is <br />attaehed hereto as Exhibit A, with only such changes to said Agreement that are acceptable to the <br />!vlayor and approved by the Director of Law as not substantially adverse to the City. ?'he <br />character of any such change as not being sul7stantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and its approval by the Director of <br />Law. <br />SECTION 2: That this Resolution shal] talce effect and be in force from and atter the earliest <br />period allowed by law.
