<br /> <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2008 - 5 <br />BY: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO AN <br />AGREEMENT WITH THE NORTH OLMSTED CITY SCHOOL DISTRICT <br />FOR THE PROVIDING OF FUEL AND ROAD SALT TO THE SCHOOL <br />DISTRICT, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted and the North Olmsted City School District have in <br />the past had an informal agreement with respect to the City providing fuel and road salt to the North <br />Olmsted School District; and <br />WHEREAS, the Administration and this Council, acting on the recommendation of the <br />Director of Law, believe that it is appropriate to set down in writing the understanding of the parties <br />with respect to not only accessibility to City property but also the cost to be charged to the School <br />District for providing such products; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into an agreeinE.,,t <br />on behalf of the City of North Olmsted with the North Olmsted City School District, retroactive <br />to January 1, 2008, for the providing to the City School District of fliel and road salt, all of which <br />will be in accordance with the Agreement which is attached hereto as Exhibit A, with only such <br />changes to said Agreement that are acceptable to the Mayor and approved by the Director of Law <br />as not substantially adverse to the City. The character of any such change as not being <br />substantially adverse to the City shall be evidenced conclusively by the execution of the <br />agreement by the Mayor and its approval by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />iininediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that the Agreement must go into effect immediately to insure the legality of future <br />sales of fuel and road salt to the North Olmsted schools, and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />
