?. <br />F <br />AGREEMENT /1ND RIGHT OF ENTRY <br />FOR FYRE TRAINING PURPQSES <br />THIS AGREEMENT is made this (day) of _ (month), 2008 by and <br />between the (owners name), (owners <br />address) , (city), OH (zip code) (hereinafter referred to as the <br />"Grantor") and CUYAHUGA COMMt1NITY COLl.EGE DISTRICT, through its Fire <br />Training Academy, (hereinafter "CCC") and the CITY OF NOR'PH OLNlSTED <br />(hereinafter referred to as the "City"). <br />WITNESSETH: <br />WHEREAS, the Grantor is the owner of property located at 4780 C{ague road, <br />North Olmsted, OH, 44070 (hereinafter the "premises"); and <br />WEREAS, structure(s) and appurtenances have been built upon the premises; <br />and <br />WHEREAS, Grantor is desirous of destroying and/or demolishing the existing <br />structures in order to redevelop the premises; and <br />WHEREAS, the Grantor has agreed to permit CCC and the City to burn and <br />destroy such structures during the course of training exercises for City Fire Department <br />personnel and CCC students; <br />NOW, THEREFORE, Grantor and CCC and the City, for the mutual considerations <br />hereinafter set forth, agree as follows: <br />l. Grantor hereby grants to CCC and the City, their officers, employees, <br />agents and students, a temporary right of entry from April 18,2008 through May 4,2008 <br />in, upon and across the premises to perform fire-fighting training exercises and to burn <br />and destroy the existing structures located on such premises <br />2. Grantor represents and warrants that no insurance or liens are in effect <br />on the structures. <br />3. Grantor shall be responsible for all utilities to be disconnected and shall <br />notify CCC and the City upon disconnection of all utilities. <br />4. CCC and the City agree to provide and be responsible for all equipment, <br />personnel and suppiies required to permit the training exercises to be carried out in a <br />safe manner. <br />5. CCC shall be responsible for obtaining all necessary permits, licenses <br />and/or approvals for such training exercises from the Ohio Environmental Protection <br />Agency and for notifying the City and Grantor upon receipt of same. <br />6. CCC shall provide liability insurance coverage in the amount of <br />$2,000,000.00 naming the City and the Grantor as additional insured's providing that all <br />instructors, students and fire-fiqhting personnel from the Ciry are insured and protected.
