extended to the next regular business day. If the Employer fails to reply within <br />the specified time limits, the Grievance shall automatically move on to the next <br />step. The time Iimits specified for either party may be extended only by written <br />mutual agreement. <br />H. This procedure shall not be used for the purpose of adding to, subtracting from, or <br />altering in any way the provisions of this Agreement. <br />8.3 All Grievances shall be administered in accordance with the following steps: <br />STEP 1- The Grievance shall be discussed between the employee involved and the <br />Association representative Qf his choice, and his Shift Of?'icer within ten (10) days of the <br />occurrence on which the Grievance is based. If a settlernent satisfactory to the parties cannot be <br />reached within five (5) days of the initial gresentation of the Grievance, the Aggrieved Party <br />shall reduce the Grievance to writing as per Sectian 8.2 (A) and submit his written grievance to <br />the Shift Officer. The Shift Officer shall indicate the date and time of receipt of the grievance, <br />and affix his signature to the grievance fartn, and, within ten (10) days submit the grievance to <br />the Fire Chief with a written report stating the substance of the grievance and any necessary <br />background information that may be pertinent to the grtevance. Copies of any written statements <br />and documents shall be grovided to the aggrieved party as we11. Written grievances can not be <br />resolved at STEP 1 of the grievance procedure. <br />In the event of an employee's discharge from employment, the Grievance shall be <br />submitted at Step 3 with a written Grievance submitted to the Director of Public Safety within <br />ten (10) days of the clischarge of the employee. <br />STEP 2- The Fire CYtief shall render a written decision within ten (10) days after receipt <br />of the Grievance. The Fire Cliief rnay convene a hearing during that ten (10) day period with the <br />agbrieved party and the Association representative of the aggrieved party's choice. <br />STEP 3- If the Aggrieved Party initiating the Crrievance is not satisfied with the written <br />decision af the Fire Chief at the conclusion of Step 2, a written appeal of the decision may be <br />filed with the Birector of Public Sa.fety within ten (10) days from the date of the written decision <br />rendered by the Fixe Chief at Step 2. Copies of the written decision shall be submitted with the <br />appeal. <br />The Director af Public Safety shall canvene a hearing within ten (10) days of the receipt <br />of tne appeal. The hearing will be held with the Aggrieved Party and his Association <br />representative. The Director of Public Safety shall issue a written decision to the employee and <br />his representative if requested, within ten (10) days from the date of the hearing. <br />STEP 4- If the Grievance is not satisfactorily settled at Step 3, the Association, may, <br />within thirty (30) days after receipt of the Step 3 decision, submit the matter to <br />arbitration. The Association shall notify the Employer of its intent to appeal the <br />Grievance to arbitration in writing. Within ten (10) days, representatives of the <br />Association shall send a written notice of its intent to arbitrate the Grievance to the <br />??
