10.9 The Employer shall make every attempt to notify an Association representative in the <br />event of any written discipline, suspension or discharge before the action is taken. <br />ARTICLE XI OVERTIME <br />11.1 The Fire Chief will be the final authority in determining the need for overtime. <br />11.2 Overtime shall be paid in one-half (1/2) hour increments. With respect to overtime and <br />Call Back, employee's may be required to stay the entire time if in the discretion of the Chief or <br />designee the same is necessary. Employees shall receive a minimum of overtime compensation <br />as listed below, providing such time does not abut the employee's regularly scheduled work day. <br />Holdover - Minimum 1/2 Hour <br />Callback - Minimum of Two (2) Hours <br />Paramedic Class - Minimum of Two (2) Hours <br />Training - Minimum of Two (2) Hours <br />Meetings - Minimum of Two (2) Hours <br />Rocky River Municipal Court - Minimum ef Two (2) Hours <br />Common Pleas Court - Minimum of Four (4) Hours <br />7uvenile Court - Minimum of Faur (4) Hours <br />Appearance at a Grand Jury - Minimum of Four (4) Hours <br />Early Start for Training - Minimum of One (1) Hour <br />All Other Overtime - Minimum of 2 Hours <br />113 Employees may request payrnent of Overtinle at any tirne. Employees shall be paid for <br />all Overtune hours accumulated in excess of one hundred twenty (120) hours on January 15, <br />April 15, July 15, and October 15 each year. <br />11.4 Any cash payment far Overtime shall be paid at the rate of pay at which it was earned <br />aftex applying Longevity increment applicable. <br />11.5 Upon retirement or death, an Employee or his estate shall be paid for a11 accuxnulated <br />Overtime. <br />11.6 Upon promotion or change in rank, a11 accumulated Overtime will be paid at the rate the <br />Overtime was earned. <br />11.7 Effective January 1, 2008, all overtime for line personnel shall be paid at the rate of one <br />and one-haTf (1 %2) times the employee's basic hourly rate, calculated on a fifty and four-tenths <br />(50.4) hourly workweek, except for the single exception of emergency holdovers (emergency <br />holdover is defined to mean when personnel are held over because they are on an emergency run, <br />and their tour of duty has ended), which shall be paid at the forty (40) hour rate. Overtime for <br />staff personnel shall be paid at the rate of one and one-half (1 '/2) times the employee's basic <br />hourly rate for all hours actually worked in excess of eighty (80) hours in any bi-weekly pay <br />period. <br />11 <br />??
