<br />Ordinance No. 2008-83 <br />the City of North Olmsted be submitted to the electors of the City of North <br />Olmsted at municipal election to be held at the usual places of voting in the City <br />on Tuesday, November 4, 2008: <br />That paragraph (a) of Article III, Section 5 of the Charter be amended to <br />read as follows: <br />ARTICLE III. THE MAYOR <br />SEC. 5. DUTIES AND POWERS OF THE MAYOR. <br />(a) Executive Powers. The Mayor shall be the chief executive officer of <br />the City. He shall supervise the administration of the City's affairs and shall <br />exercise control over all departments and divisions. He shall be the chief <br />conservator of the peace within the City and shall cause all laws and ordinances to <br />be enforced. He shall be responsible for the preparation and submission of the <br />annual estimate of receipts and expenditures, and of appropriation measures, and <br />shall at all times keep the Council fully advised as to the financial condition and <br />needs of the City. He shall cause all terms and conditions imposed in favor of the <br />City or its inhabitants in any franchise or contract to which the City is a party to <br />be faithfully kept and performed. <br />The Mayor shall have the power to appoint, promote, transfer, reduce or <br />remove any officer or employee of the City that he or she is expressly authorized <br />by this Charter, or by ordinance of Council, to appoint. Each mayoral <br />appointment of the head of a department shall be subject to the consent and <br />approval of Council, which may disapprove such an appointment only by a vote <br />of not less than two-thirds vote of its members. The appointment of every officer <br />and employee appointed by the Mayor shall, unless otherwise provided in this <br />Charter, automatically terminate at the earlier of (1) the end of the term of office <br />of the Mayor making the appointment, or (2) the date upon which the Mayor <br />making the appointment leaves office by death, resignation or other reason <br />creating a vacancy in the office of Mayor.
