Ordinance No. 2008 - 92 <br />Emergency Dispatch, with the exception of wages and benefits, an excise tax is hereby levied <br />when lodging in a hotel, motel, or motor inn is or is to be furnished to transient guests. Such excise <br />tax to become effective ten days after this ordinance becomes effective. <br />The tax is three percent of the amount paid or to be paid by, or on behalf of, the transient <br />guest for the lodging. The tax applies and is collectible at the time the lodging is furnished, <br />regardless of the time when the amount paid for lodging is paid. The tax does not apply to lodging <br />furnished to the State or any of its political subdivisions. <br />For the proper administration of this chapter and to prevent evasion of the tax, it is <br />presumed that all lodging furnished by hotel, motels, and motor inns in this City is to be to <br />transient guests and is subject to the tax until the contrary is established. <br />SECTION 2: That, in all other respects, the sections of Chapter 745 that are not <br />amended herein shall remain in full force and effect. <br />SECTION 3: That all ordinances or resolutions, or parts of ordinances or resohitions, <br />that are inconsistent or in conflict with the newly amended Section 745.02 are hereby repealed to <br />the extent of such inconsistency or conflict only. <br />SECTION 4: That, if any section, paragraph, sentence, clause, phrase, term, provision or <br />part of this Ordinance, or Chapter 745, shall be adjudged by any court of competent jurisdiction <br />to be invalid or inoperative, such judgment shall not affect, impair or invalidate the remainder <br />thereof, but shall be confined in its operation to the section, paragraph, sentence, clause, phrase, <br />term, provision or part thereof directly involved in the controversy in which such judgment shall <br />have been rendered. <br />SECTION 5: That this Ordinance shall take effect and be in force from and after the <br />earliest period provided for by law. <br />l <br />6??,c.???,??-J d OC.-'y <br />PASSED: ? <br /> <br />First Reading.• et' <br />Second Reading.• y 19 ?? <br />Third Reading: _ <br />Committee: ? <br />ATST.• <br />Gt.rc.t.ec.
