Undcr protacals devcloped by the <br />PUCO, problems relatect to bilj'ing or service shali be dirrcteci to the appropriate parcies: the <br />distributior? utility or the selected Supplier(s). <br />2.6.2 Responsibilities <br />All Aggregation Program partieipants 'sball meet all standards and responsibilities <br />required by the PUCn, including timely payment af billings acid access to esscntiat metcring and <br />other equipmcnt to carry out utility aperations. <br />2.6.2.1 Taxes <br />The selecied Supplier(s) shati include vn the participating consumer's bill and remit to <br />the appropriate authority aIi sales, gross receipts, or excise or similar taxes imposed with respect <br />to the cotzsumption of etectricity. Participating consumers shall be responsiblc for a!I taxes <br />(except for taxes an the Supptier's incame). Participating consumers shall be responsible for <br />identifying and requesting any applicabie exemptipn from the eollection of any tax by providing <br />appropriate documeniation ta the Supplier. <br />3.0 Urganizational Structure and Governance of the Aggregation Fragram <br />3.1 pescription vf Organization and Managemcnt ef Aggrtgation Program <br />Eacli NOPEC rnember community has one representative on the NOPEC Assembly, <br />which strves as the legislative body for the vrganization. Assembly membars from eaeh county <br />represented in the membership of NOPEC clect a member to the Aoard vf Directors. <br />NOPEC acts as agent for membcr communities to estabiish the Aggregation Program in <br />accordance with law and to provide rnanagerial, teehnical, and financial resources tv acquire <br />servict and financial guarantces sufficient to protect consumers and the electric distribution <br />uiility. NOPEC has developed a firmly based orgaeuzation and employed legal and technicai <br />assistance from expericnccd and tughly reputable ftrms to ur.dertake se*vicc acquisicion. <br />NOPEC's legal counsel, Artcr & Hadder. LLP, handles the legal needs vf ctiergy <br />producers, energy consumers in both the public and the privata scctvr, as wcll as <br />new energy rnarkettrs, ptovidirsg legal sarvices ranging from rcprescntation in <br />regulatory proceedings, to negotiating new contracttiat relationships, to handling <br />the acquisition, dispasitian and itnaticing of energy businesscs and facilities. <br />Artcr & Hadden LLP has advised numerous Ohio paliticat subdivisions in <br />connection with the deregulation energy markets in Ohio. <br />14 <br />«
