" ? <br />w <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000-168 <br />BY: Mayor Musial and the Entire Council <br />AN ORDINANCE APPROVING AN AGREEMENT WITH <br />THE BOARD OF TRUSTEES OF THE CUYAHOGA COUNTY <br />PUBLIC LIBRARY CONCERNING THE ACQUISITION, <br />CONSTRUCTION, LEASE AND OCCUPANCY OF REAL <br />PROPERTY AND THE PURCHASE AND USE OF PERSONAL <br />PROPERTY FOR THE PURPOSE OF OPERATING A FREE <br />PUBLIC LIBRARY; AND DECLARING AN EMERGENCY. <br />WIMREAS, upon the request of the Board of Trustees (the Library Trustees) of the <br />Cuyahoga County Public Library (the Library), this Council submitted to the electors of the City of <br />North Olmsted, and those electors approved, at an election held on November 7, 2000, the question <br />of issuing bonds of the City, including anticipatory securities, in the aggregate principal amount of <br />$10,750,000 for the purpose of constructing, furnishing, equipping and otherwise improving a free <br />public library building (the New Building) and acquiring, preparing, landscaping and otherwise <br />improving its site (the New Site and, together with the New Building, the New Facility), to replace <br />the facilities that now serve as the North Olmsted Branch of the Library located at 27425 Butternut <br />Ridge Road, North Olmsted, Ohio (the Existing Facility); and <br />WHEREAS, this Council finds and determines that it is appropriate, prior to proceeding <br />further with the planning and financing of the New Facility, to enter into a cooperative agreement <br />with the Library Trustees concerning the acquisition, construction, lease and eventual occupancy of <br />the New Facility; and <br />WHEREAS, the Mayor and the Director of Law have negotiated a proposed form of such a <br />cooperative agreement with the Library Trustees, a copy of which has been placed on file with the <br />Clerk of Council; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, <br />Cuyahoga County, Ohio, that: <br />Section l. The Mayor is authorized and directed to sign and deliver, in the name and on <br />behalf of the City and in his official capacity, an Agreement between the City and the Library <br />Trustees in substantially the form now on file with the Clerk of Council. The Agreement is <br />approved, together with any changes or amendments that are not inconsistent with this ordinance <br />and not substantially adverse to the City and that are approved by the Mayor and the Director of <br />Law on behalf of the City, all of which shall be conclusively evidenced by the signing of the <br />Agreement or amendments thereto and its or their written approval as to form by the Director of <br />Law. The Mayor, the Director of Law, the Director of Finance and other appropriate City officers <br />are also authorized and directed to take any and all other actions as are necessary and appropriate to <br />carry out the obligations of the City under the Agreement and are consistent with this ordinance. <br />
