<br />Av AGREENLENT CONCERIVING THE ACQUISITION, CONSTRUCTION,
<br />LEASE AlYD OCCUPANCY OF REAt, PROPERTY AND THE PURCHaSE AND
<br />USE OF PERSONAL PROPERTY FOR THE PURPOSE
<br />OF OPERATING A FREE PUBLIC LIBRARY
<br />THIS AGREEMENT (the Ag:-eement), made and entered into as of December 19,
<br />2000, by and between the City of North Olmsted (the City), a mvnicipal corporation duly
<br />organized and validly existing under the Constitution and laws of the State af Ohio and its City
<br />Charter, and the BOARD OF TRUSTEES (the Trustees) of the CUYAHOGA CO[NTY
<br />PUBLIC LIBRARY (the Library), a county library organized and existing under Chapter 3375 of
<br />ti7e Revised Code,
<br />WITNESSETH THAT:
<br />WHEREAS, upon the request of the Trustees, the City Council submitted to the
<br />electors of the City at an election on November 7, 2000, the question of, and those electors
<br />approved, the issuance of general obiigation bonds, incIudin? anticipatory secusities, in the
<br />aQa egate principal amount of $10,750,000 (the Obligations), for the purpose of constructing,
<br />fumishing, equipping and otherwise improving a free public Iibrary building (the New Building)
<br />and acquiring, preparing, landscaping and otherwise improving its site (the Site and, tagether
<br />with the New Building, collectively, the New Facility); and
<br />WHEREAS, it is the intent of the City to groceed with the acquisition, preparation,
<br />landscaping and improvement of the Site and the construction, furnishing, equipping and
<br />improvement of the New Building in order_to provide a facility to be operated by the Trustees ta
<br />replace the existing branch of the Library located at 27425 Buttemut Ridge Road, North Olmsted,
<br />Ohio (the Existin; r"acilitY); and
