0 <br />CITY QF NORTH'OLM&TED <br />ORDINANCE NO. 2000-154 <br />BY: COUNCILMEMBER GAREAU <br />AN ORDINANCE AMENDING SECTIONS 505. 04, ENTITLED <br />"ABANDONING ANIMALS, " 505.06, ENTITLED "POISONING <br />ANIMALS, " AND 505.07, ENTITLED "CRUELTY TO <br />ANIMALS" OF THE GENERAL OFFENSES CODE, SO AS TO <br />MAKE VIOLATIONS OF EACH SAID SECTIDN OF THE <br />GENERAL OFFENSES CODE FIRST DEGREE <br />MISDEMEANOR OFFENSES, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, violations of Section 505.04 of the General Offenses Code, entitled <br />"Abandoning Animals," are presently classified as minor misdemeanor offenses, with a maximum <br />penalty of a$100.00 fine; and <br />WHEREAS, violations of Sections 505.06 and 505.07 of the General Offenses Code, <br />entitled "Poisoning Animals," are presently classified as misdemeanors of the fourth degree, with <br />a maximum penalty of 30 days in jail and a$250.00 fine; and <br />WHEREAS, this Council believes that the gravity of the above-referenced offenses <br />involving animals warrants the more serious penalties provided for misdemeanor offenses of the <br />first degree, to-wit: a maximum penalty of six (6) months in jail and a$1,000.00 fine; and <br />WHEREAS, this Council therefore wishes to amend said Sections 505.04, 505.06 and <br />505.07 to make violations of each said section to be misdemeanors of the first degree; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Sections 505.04, 505.06 and 505.07 of the General Offenses Code, <br />which presently read as follow: <br />"505.04 ABANDONING ANIMALS. <br />(a) No owner or keeper of a dog, cat or other domestic animal shall abandon such <br />animal. <br />(b) Whoever violates this section is guilty of a minor misdemeanor. <br />505.06 POISONING ANIMALS. <br />(a) No person shall maliciously, or willfully and without the consent of the owner, <br />administer poison, except a licensed veterinarian acting m such capacity, to a farm animal, <br />dog, cat, poultry or other domestic animal that is the property of another; and no person shall, <br />willfully and without the consent of the owner, place any poisoned food where it may be easily <br />found and eaten by any of such animals, either upon his own lands or the lands of another. <br />(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree. <br />.?....?. <br />? .. _
