<br />PORTER ROAD (CR-164) <br />ORDINANCE NO.: 2000-134 <br />BY; MAYOR MUSIAL <br />DATE ,' ? J1 ? G o 0 <br />An emergency ordinance enacted by the City of North Olmsted, Cuyahoga County, Ohio, hereinafter <br />referred to as the MUNICIPALITY, in the matter of the hereinafter described improvement and requests the <br />cooperation of the County of Cuyahoga by its Board of County Commissioners, hereinafter referred to as the <br />COUNTY. <br />WHEREAS, the MUNICIPALITY has recognized the need for and proposes the improvement of a <br />portion of public highway which is described as follows: <br />The repair and resurfacing of Porter Road (CR-164) from Lorain Avenue to the North Olmsted North <br />Corporation Line. <br />NOW THEREFORE, be it ordained by the City of North Olmsted, County of Cuyahoga and Staxe of <br />Ohio; <br />A. CONSENT <br />That it is declared to be in the public interest that the consent of said MLTNICIPALITY be and <br />such consent is hereby given to the COUNTY to construct the above described improvement in <br />accordance with plans, specifications and estimates approved by the COLJNTY. <br />B. COOPERATION <br />That the COLJNTY and the MUNICIPALITY will cooperate in the repair and resurfacing of <br />Porter Road (CR-164) from Lorain Avenue to the North Olmsted North Corporation Line. <br />2. That the COUNTY will arrange for the preparation of construction plans and specifications, <br />including necessary engineering reports for improvement, under current Cuyahoga County <br />Engineer standards for construction of County roads and bridges. <br />That the COLJNTY will arrange far the supervision and administration of the construction <br />contract. <br />C. FLJNDING <br />1. That the MUNICIPALITY hereby agrees to participate with the COUNTY in the cost of the <br />improvement by an allocation from the County Motor Vehicle License Tax Fund to pay the <br />COLJNTY portion of the project. <br />2. That if funds administered by the Ohio Public Works Commission are used for this project, the <br />amount of such funds will be deducted from designated project costs prior to the application of the <br />participatory percentages specified in this Agreement. <br />3. That within the Corporate Limits of the MLJNICIPALITY, the MiJNICIPALITY shall contribute <br />twenty percent (20%) of the cost of construction, construction supervision, right-of-way, and <br />incidentals and forly percent (40%) of the cost of prepazation of plans and specifications.
