<br />.:?;. <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2000-132 <br />BY: MAYOR MUSIAL AND ALL MEMBERS OF COUNCIL <br />A RESOLUTION IN SUPPORT OF THE MADELYNE HALL-MATTHEW <br />MCCONNELL-AKIN STEWART HOME DAY CARE SAFETY ACT <br />WflEREAS, Senator Merle Kearns, Rep. Amy Salerno, and Edward S. Jerse have <br />proposed the "Madelyne Hall-Matthew McConnell-Akin Stewart Home Day Caxe Safety Act," a <br />bill to improve safety at day care facilities, particularly in-home day cares. This bill is currently <br />before the Ohio House of Representatives for their consideration. The proposed bill will make it <br />a crime for a day-care provider to misrepresent to a parent or government official any of the <br />following if the misrepresentation places the health or safety of a child substantially at risk: (1) <br />the number of children receiving child day-care at one time in the home; (2) the area of the <br />facility being used for day-care or (3) the provider's credentials. In addition, if a day-care <br />provider recklessly causes serious physical harm to a child under eleven years of age in their care <br />it will be a crime for this violation; and <br />WHEREAS, this bill modeled on a New York law, is named after three (3) <br />children Madelyne Hall, Matthew McConnell and Akin Stewart who died or suffered serious <br />injuries in home day-cares in our districts. Currently the State of Ohio has few regulations of in- <br />home day-cares and virtually no enforcement of these regulations. Because of this, enforcing <br />limits, currently set by the law, on the number of children being cared for in home day-cares <br />enforcement issues have arose. There is a need for these safety rules and penalties to help parents <br />avoid the tragedies others have already experienced; and <br />WHEREAS, this bill proposes that the State of Ohio have stricter guidelines and <br />imposes penalties for those who disregard the law and give the law enforcement officials the <br />power to uphold and enforce the law in order to save lives and provide the necessary precautions <br />to protect young children and give the parents the peace of mind they deserve regarding <br />placement of their child in a home day-care setting. <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1. That this Mayor and City Council recognize the necessity of this bill in order to <br />save and protect young children and impose penalties for violators. We urge the State of Ohio <br />House of Representatives to pass this Bill for the welfare and safety of our young children and <br />their families. They deserve this piece of mind and protection and for the preservation of lives. <br />
