WHEREAS, the Director of Law, consistent with the Charter under Article V, Section 2, <br />requests that he be authorized to procure the services of Calfee, Halter & Griswold, L.L.P. to assist <br />in negotiating a resolution to the aforesaid lawsuit. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYEIHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Law be, and he hereby is, authorized to retain the <br />services of Calfee, Halter & Griswold, L.L.P. to represent the City of North Olmsted in the case of <br />United States v. City of North Olmsted, Case No. 1:95 CV 1109, Northern District of Ohio, <br />Eastern Division, which agreement sha11 be consistent with the proposal that is attached hereto and <br />made a part hereof and marked Exhibit A. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to retain the services of Calfee, Halter & Griswold <br />due to the threat of the United States Government to proceed to collect on stipulated fines and <br />penalties, and further provided that it receives the affirmative vote of two-thirds of a11 members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />, <br />PASSED: First Reading: <br />Second Reading: -Third Reading: <br />ATTEST: _ Committee: ?- <br />9 RA L.
