CITY OF NORTH OLMSTED ORDINANCE NO. 2000-118 BY: COUNCILPERSONS GAREAU, KASLER AND MILLER AN ORDINANCE CREATING NEW SECTION 1139.14 OF CHAPTER 1139 OF THE ZONING CODE, ENTITLED "IRRIGATION OFI.ANDSCAPED AREAS,"SO AS TO REQUIRE THAT ALL LANDSCAPED AREAS LOCATED ON PARCELS OF LAND WITHIN THE GENERAL RETAIL BiISINESS DISTRICT BE SERVICED BY UNDERGROUND IRRIGATIONSYSTEMS. WHEREAS, the City's Zoning Code presently requires that parking and other improved areas of parcels of land located within the general retail business district of the City be buffered by landscaped areas; and WHEREAS, the failure to properly irrigate such landscaped areas results in the loss of planting and a concomitant failure of the landscaped area as a buffer; and WHEREAS, poorly irrigated landscaped areas also contribute to blight in the commercial district and adversely affect property values; and WHEREAS, it is the desire of this Council to require that all newly created or reconstructed landscaped areas within the general retail business di?trict be serviced by underground irrigation systems; and , WHEREAS, the Planning Commission on the day of 2000, by formal motion, recommended that this Ordinance, creating new Section 139.14 of the Zoning Code be (appreroed) iiisapproved ?--- NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTIONI: That there be and hereby is created new Section 1139.14 ofthe Zoning Code, entitled "Irrigation of Landscaped Areas," which, as created herein, shall read in its entirety as follows: "1139.14 IItRIGATION OF LANDSCAPED AREAS. All landscaped areas which are a required part of a development or redevelopment plan of any parcel of land located within the General Retail Business District shall be serviced by an underground irrigation system. The plans for such irrigation system must be submitted to the Building Official, along with the developer's application for a building permit pursuant to the provisions of Chapter 1126 of the Zoning Code, and shall thereafter be reviewed by and subject to the recommendations of the Planning Commission as to irrigation sufficiency.
