CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000-118 <br />BY: COUNCILPERSONS GAREAU, KASLER AND MILLER <br />AN ORDINANCE CREATING NEW SECTION 1139.14 OF CHAPTER 1139 OF THE <br />ZONING CODE, ENTITLED "IRRIGATION OFI.ANDSCAPED AREAS,"SO AS TO <br />REQUIRE THAT ALL LANDSCAPED AREAS LOCATED ON PARCELS OF LAND <br />WITHIN THE GENERAL RETAIL BiISINESS DISTRICT BE SERVICED BY <br />UNDERGROUND IRRIGATIONSYSTEMS. <br />WHEREAS, the City's Zoning Code presently requires that parking and other improved areas <br />of parcels of land located within the general retail business district of the City be buffered by <br />landscaped areas; and <br />WHEREAS, the failure to properly irrigate such landscaped areas results in the loss of <br />planting and a concomitant failure of the landscaped area as a buffer; and <br />WHEREAS, poorly irrigated landscaped areas also contribute to blight in the commercial <br />district and adversely affect property values; and <br />WHEREAS, it is the desire of this Council to require that all newly created or <br />reconstructed landscaped areas within the general retail business di?trict be serviced by <br />underground irrigation systems; and <br />, <br />WHEREAS, the Planning Commission on the day of 2000, by <br />formal motion, recommended that this Ordinance, creating new Section 139.14 of the Zoning Code <br />be (appreroed) iiisapproved <br />?--- <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTIONI: That there be and hereby is created new Section 1139.14 ofthe Zoning Code, <br />entitled "Irrigation of Landscaped Areas," which, as created herein, shall read in its entirety as <br />follows: <br />"1139.14 IItRIGATION OF LANDSCAPED AREAS. <br />All landscaped areas which are a required part of a development or redevelopment plan of any <br />parcel of land located within the General Retail Business District shall be serviced by an underground <br />irrigation system. The plans for such irrigation system must be submitted to the Building Official, <br />along with the developer's application for a building permit pursuant to the provisions of Chapter <br />1126 of the Zoning Code, and shall thereafter be reviewed by and subject to the recommendations <br />of the Planning Commission as to irrigation sufficiency. <br />
