(d) Penalties. Whoever violates paragraph (b) of this Section shall be guilty of a <br />minor misdemeanor and shall not be fined more than $3." <br />SECTION 2: During the first ninety (90) days following the effective date of this <br />Ordinance, enforcement of this Ordinance by law enforcement officers shall be limited to the <br />issuance of warning notices to motorists, who have been otherwise lawfully stopped as <br />provided for in Section 331.41(c) of the Codified Ordinance. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is immediately necessary to regulate the use of cell phones while operating <br />motor vehicles in the City of North Olmsted in order to prevent injury to and the death of <br />residents in this community, and further provided that it receives the affirmative vote of two-thirds <br />of all members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor, but shall no longer be in force, and shall terminate without further action <br />of this Council, on and after the one year anniversary of the date upon which it first takes effect <br />and is in force. <br />PASSED: C'/ilt`'`,.d.'r°?
