WHEREAS, the City Law Department negotiated the substance of these minor changes with the <br />U. S. Department of Housing and Urban Development in April and May 2000; and <br />WHEREAS, on June 5, 2000, the City's Fair Housing Review Board adopted the minor changes <br />as agency policy, pursuant to its rulemaking powers under C.O.N.O. § 1901.11(B)(3); and <br />WHEREAS, this Council desires to incorporate the federal government's final minor changes in <br />Chapter 1901, in order to obtain a final and permanent ruling that the City's Fair Housing Code <br />is substantially equivalent to federal law; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1901.03, which currently reads as follows: <br />1901.03 DEFIMTIONS. <br />(a) "Ascribed status" pertains to an individual's race, color, religion, sex, ancestry, familial <br />status, age, sexual orientation, national origin, and/or handicap. <br />(b) "Board" means the Fair Housing Review Board created by this chapter in Section <br />1901.11. <br />(c) "Covered multi-family dwellings" means buildings consisting of four or more units if <br />such buildings have one or more elevators and ground floor units in other buildings consisting of <br />four or more units. <br />(d) "Demographic composition" means any description of a geographical area by reference <br />to its residents' ascribed status. <br />(e) "Discriminate" or "discrimination" means to separate or segregate persons in a particular <br />manner solely or in part because of ascribed status provided that "discriminate" or <br />"discrimination" shall not include special outreach efforts conducted by or under the authority of <br />units of local government (including agencies, departments and commissions thereof) or non- <br />profit fair housing corporations or agencies to ensure that persons of minority groups are fully <br />informed of, and have access to, available dwelling opportunities in areas of present or <br />prospective majority group concentration, or to ensure that persons of the majority group are <br />fully informed of and have access to available dwelling opportunities in areas of present or <br />prospective minority group concentration. <br />(fl "Dwelling" means a building or structure, or part thereof, used or designed or intended to <br />be used for residential purposes, and any vacant land which is offered for sale or lease for the <br />construction or location thereon of any such building, structure, or portion thereof. <br />2 <br />
