<br />,.. . ._.,.,? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000 - 77 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORTZING THE MAYOR TO CONSENT TO <br />AMENDED USE RESTRICTIONS ON THE NORTH OLMSTED <br />GOLF COURSE IN ORDER TO ALLOW FOR THE <br />CONSTRUCTION OF A HALL OF FAME AND ADIVIINISTRATIVE <br />BUILDING. <br />WHEREAS, by Ordinance 92-1, this Council amended the Zone Map of the City to change <br />the property described as Properties A and B in Appendices A and B hereto to Single Family Cluster <br />zone; and <br />WHEREAS, during consideration of that rezoning, the ovcmer of Parcels A and B entered into <br />a"Declaration of Restrictions" limiting the future use of Property A to use as a golf course, which <br />Declaration was filed for Record on June 29, 1992 in Cuyahoga County Records, Volume 92-5544, <br />Page 36, which declaration is still in effect, and under which the City is a third-party beneficiary, with <br />power to enforce the restrictions, and whose written consent is required for any amendment or <br />modification of such restrictions; and <br />WHEREAS, the current owner of Property A, Northern Ohio Golf Association Charities and <br />Foundatioq Inc., wishes to construct a new building to house a hall of fame and administrative offices <br />related to the operation of the hall of fame and the organization; and <br />WHEREAS, this proposed construction may or may not conflict with the terms of the <br />existing restrictions on use of Property A; and <br />WHEREAS, this Council has no objection to the construction of such building, as it will <br />advance the general welfare of the City and its residents and visitors; and <br />WHEREAS, this Council desires to authorize the Mayor to consent in writing to the amended <br />restrictions proposed by Northern Ohio Golf Association Charities and Foundation, Inc. in order to <br />express its lack of objection to the proposed construction. <br />page 1 <br />
