incident to the construction, operation and maintenance and, from time to time, to alter, <br />repair or remove the same. Upon completion of construction and installation of the <br />sewer, Grantee shall restore the premises to its original condition. Grantee shall maintain <br />the sewer and appurtenances thereto, and defend and hold Grantor harmless for any <br />mechanic's liens resulting therefrom and from any damages, losses, expenses, suits, <br />claims or causes of action arising from or occasioned by the existence of said easement. <br />The Grantor hereby agrees to restrict the use of said premises within the limits of <br />the above described easement against the construction thereon or above or subjacent <br />thereto any buildings, structures, tunnels, or excavation therein in any manner interfering <br />with said sewer whatsoever, the access thereto, or the maintenance thereof, or otherwise <br />interfering therewith; provided that, notwithstanding the foregoing restrictions and <br />prohibitions Grantor may ma.ke any of the uses or do any of the things to the foregoing <br />premises with the express written consent of the Grantee. Such reserved and permitted <br />usage shall include inter alia, landscaping, parking of vehicles within the regulations set <br />forth in the Codified Ordinances, paving, streets, driveways, sidewalks and the <br />maintenance thereof, all within the regulations set forth in the North Olmsted Codified <br />Ordinances. <br />Grantor shall fully use and enjoy the aforesaid premises except as to the rights <br />herein granted; and agrees to maintain premises, and keep hold and save the said Grantee <br />harmless for any and all damages arising from its use of the right, easement, and right-of- <br />way herein granted and agrees to maintain, repair and restore to its original condition, <br />(except for removal of necessary trees and shrubs) the premise located within said right- <br />of-way. <br />2 <br />
