CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000 - 50 <br />BY: Councilman George Nashar <br />AN ORDINANCE ACCEPTING A SANITARY SEWER PUMP STATION AND FORCE <br />MAIN EASEMENT LOCATED ON PROPERTY OWNED BY MOEN INCORPORATED, <br />AND DESIGNATED AS PERMANENT PARCEL NOS. 236-11-18 AND 236-12-10 ON TI-E <br />CUYAHOGA COUNTY MAPS AND RECORDS, AND DECLARING AN EMERGENCY. <br />WHEREAS, Moen Incorporated desires to grant to the City of North Olmsted an <br />easement for a sanitary sewer pump station and force main on real property located adjacent to the <br />westerly end of A1 Moen Drive, in the City of North Olmsted. and designated as Permanent Parcels <br />236-11-18 and 236-12-10 by the Cuyahoga County Auditor; and <br />WHEREAS, said sanitary sewer pump station and force main has already been <br />constructed and is in use on said property, and said easement is now being granted in order to <br />confirm the City's legal right to use and maintain the pump station and force main; and <br />WHEREAS, said easement is shown and described in Exhibits "A" and " B, " which are <br />attached to this ordinance; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts the easement from Moen Incorporated for a sanitary <br />sewer pump station and force main, in form and substance as shown on Exhibits "A" and " B," <br />which are attached hereto and incorporated herein by reference as if fully rewritten. <br />SECTION 2: That the Mayor is hereby authorized to execute, on behalf of the City, any <br />documents necessary to effect the acceptance of said easement, and the Engineer is hereby directed <br />to cause said easement, when fully executed, to be recorded in the office of the Cuyahoga Country <br />Recorder. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health and safety of the City, and for the <br />further reason that it is important to execute said easement immediately in order to confirm the <br />City's legal right to use and maintain the said sanita.ry sewer pump station and force main, and <br />further provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
