CITY OF NORTH OLMSTED ORDINANCE NO. 2000 - 50 BY: Councilman George Nashar AN ORDINANCE ACCEPTING A SANITARY SEWER PUMP STATION AND FORCE MAIN EASEMENT LOCATED ON PROPERTY OWNED BY MOEN INCORPORATED, AND DESIGNATED AS PERMANENT PARCEL NOS. 236-11-18 AND 236-12-10 ON TI-E CUYAHOGA COUNTY MAPS AND RECORDS, AND DECLARING AN EMERGENCY. WHEREAS, Moen Incorporated desires to grant to the City of North Olmsted an easement for a sanitary sewer pump station and force main on real property located adjacent to the westerly end of A1 Moen Drive, in the City of North Olmsted. and designated as Permanent Parcels 236-11-18 and 236-12-10 by the Cuyahoga County Auditor; and WHEREAS, said sanitary sewer pump station and force main has already been constructed and is in use on said property, and said easement is now being granted in order to confirm the City's legal right to use and maintain the pump station and force main; and WHEREAS, said easement is shown and described in Exhibits "A" and " B, " which are attached to this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the City hereby accepts the easement from Moen Incorporated for a sanitary sewer pump station and force main, in form and substance as shown on Exhibits "A" and " B," which are attached hereto and incorporated herein by reference as if fully rewritten. SECTION 2: That the Mayor is hereby authorized to execute, on behalf of the City, any documents necessary to effect the acceptance of said easement, and the Engineer is hereby directed to cause said easement, when fully executed, to be recorded in the office of the Cuyahoga Country Recorder. SECTION 3: That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health and safety of the City, and for the further reason that it is important to execute said easement immediately in order to confirm the City's legal right to use and maintain the said sanita.ry sewer pump station and force main, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
