(D) Upon receipt and review of the recommendations of the Housing <br />Council with respect to an application for tax exemption, and his approval of the same, <br />the Mayor shall negotiate a tax exemption agreement with the applicant, and shall submit <br />the same to City Council for its review and approval. In the process of negotiating a tax <br />exemption agreement with the applicant and subsequently submitting the sarne to City <br />Council for approval, the City shall comply with all of the requirements of Sections <br />3735.65 et seq. and Sections 5709.82 et seq. of the Ohio Revised Code, which are <br />applicable to pre-1994 CRAs as provided for by SB 19, including, but not limited, to <br />notification and, if applicable, approval procedures and requirement involving the Board <br />of Education, the County Auditor and the Ohio Department of Development. City <br />Council shall approve no tax exemption agreement pursuant to ttus Section unless the <br />agreement includes a provision which states that the applicant shall require all contractors <br />and subcontractors on the project to pay prevailing wages, as that term is described in <br />Section 4115.05 of the Ohio Revised Code, to alI laborers, workrnen and mechanics who <br />work on the project. FURTHER, EVERY SUCH AGREEMENT SHALL, AT THE <br />DISCRETION OF THE MAYOR, CONTAIN A PROVISION THAT THE <br />APPLICANT SHALL MAKE A YEARLY CONTRIBUTION OF UP TO THREE <br />PERCENT (3%), THE PERCENTAGE AS DETERNIINED BY THE MAYOR, OF <br />THE YEARLY TAX ABATEMENT VALUE TO A BONA FIDE APPRENTICESHIP <br />PROGRAM, UNLESS ALL CONSTRUCTION CONTRACTORS AND SUB <br />CONTRACTORS ON THE PROJECT CONTRIBUTE TO A BONA FIDE <br />APPRENTICESHIP PROGRAM PURSUANT TO A REQUIREMENT IN A <br />COLLECTIVE BARGAINING AGREEMENT. <br />(E) After a tax exemption agreement is finally approved, the City's Tax Incentive <br />Council shall thereafter monitor the property owner's compliance with all of the <br />provisions of the agreement, and make recommendations to the City Council, as provided <br />for by state law." <br />(F) For the purpose of this ordinance, a bona fide apprenticeship program is one <br />regulated under the auspices of the Ohio State Apprenticeship Council of the State of <br />Ohio as approved by the U. S. Department of Labor, Bureau of Apprenticeship and <br />Training. <br />SECTION 2: That any Ordinance or parts of Ordinances inconsistent with or in conflict <br />with this Ordinance, to the extent of any such inconsistency or conflict with this <br />Ordinance, be and hereby are repealed. <br />
