? <br /> <br />SECTION 1: That the revenues generated by the Advertising & Exclusivity Agreement between <br />the City of North Olmsted and the Cleveland Coca-Cola Bottling Co., Inc. be designated as <br />follows: <br />A. From the initial lump sum amount of $52,000.00: <br />To the Department of Human Resources Community Fund Account, the sum of <br />$500.00. <br />To the Springvale Golf Course and Ballroom Account, the sum of $11,100.00. <br />To the Recreation Center Account, the sum of $40,400.00. <br />B. From the annual commissions received: <br />1. Recreation Center Account to receive any and all of the commissions <br />generated from the sales at the machines located at the Recreation Center. <br />2. Springvale Golf Course and Ballroom Account to receive any and all of the <br />commissions generated from the sales at the machines located at the <br />Springvale Golf Course and Ballroom. <br />3. Skate Park Account to receive any and all of the commissions generated <br />from the sales generated at the machines located at the Skate park. <br />4. Department of Human Resources Community Fund Account to receive <br />$4,000.00 per year from the commissions generated from the sales <br />generated at the machines located at all other city sites. <br />5. Recreation Center Account to receive the remainder of the commissions <br />generated from the sales generated at the machines located at all other city <br />sites. <br />C. From the annual additional payments received: <br />Recreation Center Account to receive annual additional payments, an <br />amount of Seven Thousand Dollars ($7,000.00) per year in the month of <br />January in year two (2) through ten (10). <br />SECTION 2: That the Director of Finance be and she is hereby directed to record receipts from <br />said agreement consistent with the provisions of this Ordinance. <br />SECTION 3: That the Clerk of Council shall immediately forward an attested copy of this <br />Ordinance to the Auditor of the Cuyahoga County and the Auditor of the State of Ohio. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the preservation of the public health, safety and welfare, and for the reason that it is <br />immediately necessary to proceed with the installation of the vending machines at various sites <br />throughout the City and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and approval <br />by the Mayor. <br />2 <br />
