<br />f.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99 - 151 <br />BY: MAYOR NORMAN T. MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO <br />ENTER INTO A TEN YEAR ADVERTISING & EXCLUSIVITY AGREEMENT WITH <br />CLEVELAND COCA-COLA BOTTLING CO., INC. AS AMENDED. <br />WHEREAS: The Mayor has recommended that the City of North Olmsted enter into a ten year <br />Advertising & Exclusivity Agreement with Cleveland Coca-Cola Bottling Co., Inc. <br />wherein the City of North Olmsted will exclusively deal with them for a full service <br />vending program with up to 16 machines at various sites throughout the City of <br />North Olmsted. <br />WHEREAS: upon the recommendation of the Mayor, this Council does hereby express its <br />desire to have the Mayor enter into such an agreement with said firm for and on <br />behalf of the City. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into a ten year Advertising <br />& Exclusivity Agreement with the Cleveland Coca-Cola Bottling Co., Inc. Said Agreement shall <br />be in form and substance substantially the same as the document titled "Advertising and <br />Exclusivity Agreement," which is attached hereto and made a part hereof and marked Exhibit <br />«A» <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the preservation of the public health, safety and welfare, and for the reason that it is <br />immediately necessary to proceed with the installation of the vending machines at various sites <br />throughout the City and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and approval <br />by the Mayor. <br />
