. , <br />.?- <br />production for examination of any documents relating to any matter under investigation or <br />question before the Board. <br />(b) The appointed hearing officer must be employed by the City at all times during which he <br />or she acts as a hearing officer. A hearing officer may already be a City employee at the time of <br />his or her appointment, or may be employed by the City specifically for the purpose of serving as <br />a hearing officer. Should the hearing officer's employment terminate prior to the conclusion of <br />his or her investigation, the Board shall appoint a new hearing officer within ten (10) days of <br />termination of the hearing officer's employment. <br />(c) If the Board appoints such a hearing officer, there is no longer a requirement pursuant to <br />Section 1901.25 that no fewer than three (3) of the same members of the Board be present at all <br />times during the hearing. Notice of hearing and the procedures therefor shall be in accordance <br />with Section 1901.25 of this Chapter. After the conclusion of any hearing, the hearing officer <br />shall report these findings to the Board within seven (7) days. Within fifteen (15) days after <br />receipt of the findings of the hearing officer, the Board shall render its decision in accordance <br />with Section 1901.27 of this Chapter. <br />SECTION 5: That any Ordinance, or any part of any Ordinance, inconsistent or in <br />conflict with this Ordinance is hereby repealed. <br />SECTION 6: That this Ordinance shall take effect and be in force at the earliest date <br />allowed by law. <br />PASSED: <br />ATTEST.- <br />BARBARA L.
