<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-127 <br />BY: COUNCILMEN DEAN McKAY AND MICHAEL GAREAU, JR. <br />AN ORDINANCE PROVIDING FOR THE AMENDMENT OF <br />THE ZONE MAP OF THE CITY OF NORTH OLMSTED BY <br />CHANGING THE HEREINAFTER DESCRIBED PARCELS OF <br />REAL PROPERTY LOCATED ON KENNEDY RIDGE ROAD, <br />FROM MIXED USE DISTRICT TO SINGLE FAMILY CLUSTER <br />DISTRICT. <br />WHEREAS, a certain two parcels of vacant real property located on Kennedy Ridge Road, <br />west of Columbia Road, consisting of Permanent Parcel Numbers 236-017-005 and 236-017-015, <br />and further identified by the Legal Description mazked Exhibit A and the Map marked Elchibit B, <br />each of which is attached to this Ordinance and made a part hereof, are presently zoned for mixed <br />use development; and <br />WHEREAS, it is the desire of this Council to rezone said two (2) parcels of land to single <br />family cluster use so that the development of said two parcels may be compatible and harmonious <br />with the surrounding single-family neighborhoods to the south and west of these parcels, and the <br />multi-family building to the east; and <br />WHEREAS, this Council has determined that the said proposed rezoning, while not <br />identical to the recommendations of the City's 1992 Master Plan for these parcels, is nonetheless <br />consistent with that recommendation in that the proposed rezoning will maintain the residential <br />character of the neighborhood; permit multi-family like development density on the subject <br />parcels; and further will clearly provide inducement for good and sound development of this <br />residential neighborhood of the City and will in fact promote the health, welfare and safery of the <br />residents living in this area of this City; and <br />WHEREAS, this Council has further determined that, in light of the fact that all of the <br />properties immediately abounding these parcels to the west, east and south are already zoned and <br />being used for residential purposes, it would neither be good municipal planning nor fair to the <br />property rights of surrounding residential neighbors to permit mixed use development on these two <br />parcels; and <br />; <br />? <br />WHEREAS, the Planning Commission on 1999, by formal motion, <br />recommended that this Ordinance, rezoning the `sai parcels of land from mixed use to single <br />family cluster use, be 6p_proved?(dislpproved); <br />
