<br />"1119.01 BUII.DING PERMIT REQUIRED. <br />No excavation for a foundation, nor the erection, construction or alteration of any <br />structure or part of a structure, nor occupancy of any street or alley with the building materials, <br />nor erection of temporary structures for construction purposes, nor any improvement to real <br />property shall be undertaken until a building permit therefor has been issued by the Building <br />Official." <br />shall be, and the same is amended, and, as amended, it shall read in its entirety as follows: <br />"1119.01 BUII.DING PERMIT REQUIRED; REAL PROPERTY TAXES. <br />(a) No excavation for a foundation, nor the erection, construction or alteration of any <br />structure or part of a structure, nor occupancy of any street or alley with the building materials, <br />nor erection of temporary structures for construction purposes, nor any other improvement to real <br />property for which a building permit is required, sha11 be undertaken until a building permit <br />therefor has been issued by the Building Official. <br />(b) No building permit required by paragraph (a) above for commercial construction or <br />new residential construction shall be issued unless the applicant fust submits to the Building <br />Official a statement ftom the County Treasurer certifying either that all real property taxes due <br />and owing on the property for which the permit is sought have been paid, or that the owner has <br />entered into an agreement with the County Treasurer which will provide for the payment of all <br />real property taxes presently due and owing on the property. For purposes of this paragraph <br />only, "commercial construction" shall mean the construction of any building or building addition <br />on land in the City which is zoned for any use other than single-family, two-family or single <br />family cluster, and "new residential construction" sha11 mean the construction of any building or <br />building addition on land which is zoned for single-family, two-family or single family cluster <br />use. <br />SECTION 2: That any ordinance, or part of ordinance, which is in conflict with or is <br />inconsistent with this Ordinance, to the extent of any such conflict or inconsistency, is hereby <br />repealed. <br />SECTION3: That the Clerk of Council be and she is hereby directed to cause notice of a <br />public hearing hereon be given pursuant to the provisions of Section 14 of Article 4 of the Charter <br />of the City of North Olmsted. <br />SECTION 4: That this Ordinance sha11 take effect and be in force from and after the <br />earliest period allowed by taw as specified in the Charter of the City of North Olmsted. <br />2 <br />
