Ordinance No. 99-112 <br />Page 2 <br />furnishes lodging not subject to the tax, the vendor's records shall show the identity of the <br />transient guest, if the sale was exempted by reason of such identity, or the nature of the <br />transaction if exempted for any other reason. Such records and other documents shall be <br />opened during business hours to the inspection of the Director of Finance and shall be <br />preserved for a period of four years, unless the Director, in writing, consents to their <br />destruction within that period, or by order requires that they be kept longer. <br />(b) The Director of Finance, on an annual basis, shall audit excise returns filed each <br />year by hotel and motel vendors who are subject to the provisions of this Chapter. The results <br />of said audits shall be reported each year by the Director of Finance to the City Council, the <br />extent of said audits to be at the discretion of the Director of Finance. " <br />SECTION 2: That any Ordinance, or any part of any Ordinance, inconsistent or in <br />conflict with this Ordinance is, to the extent of any such inconsistency or conflict, hereby <br />repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare of the City <br />of North Olmsted, and for the further reason that it is immediately necessary to enact such <br />legislation to have immediately in place an audit tool to enable the Director of Finance to <br />determine whether all excises taxes due the City are being paid by hotel and motel vendors; <br />and further provided it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: <br />?
