CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-108 <br />BY: COUNCILMAN MICHAEL GAREAU, JR. <br />AN ORDINANCE CREATING NEW SECTION 929.04 OF CHAPTER 929 <br />OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE, <br />ENTITLED "UNDERGROUND UTILITY AND COMMUNICATIONS <br />SYSTEMS" TO REQUIRE THE CONSTRUCTION OF UNDERGROUND <br />SERVICE DROPS OR CONNECTIONS FROM THE PUBLIC RIGHT-OF- <br />WAY OR A UTII.ITY EASMEMENT TO COMMERCIAL BUILDINGS IN <br />THE CITY OF NORTH OLMSTED, WHICH ARE IN THE PROCESS OF <br />DEVELOPMENT OR REDEVELOPMENT, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, developers of single-family residentially zoned property have long been <br />required by this City to construct underground service drops or connections to new houses as a <br />condition to receiving a building permit to develop their property; and <br />WHEREAS, developers of commercial property in this City should, as a condition to <br />receiving the benefits of a city building permit, likewise be required, as a part of their <br />development or redevelopment of such property, to provide underground service drops or <br />connections from the public right-of-way or a utility easement to new commercial buildings or to <br />existing commercial buildings and/or other improvements on commercial property undergoing <br />substantial redevelopment; and <br />WHEREAS, this Council accordingly desires to impose such a requirement upon all <br />developers and redevelopers of commercial property within the City of North Olmsted; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there be, and hereby is, created new Section 929.04 of Chapter 929 <br />of the Streets, Utilities and Public Services Code, which, as created, shall read in its entirety as <br />follows: <br />"929.04 CONSTRUCTION OF UNDERGROUND SERVICE DROPS OR <br />CONNECTIONS UPON COMMERCIAL PROPERTIES REQUIRED. <br />(a) With all new construction; with all signs and lights constructed; with future telephones <br />and self-contained service units, such as "golden goats" and beverage machines situated away <br />from buildings, and when there is major rehabilitation of a building, that is, when the cost <br />exceeds fifty percent (50%) of building value in its pre-rehabilitation state, every such owner of <br />commercial property shall construct, or if applicable reconstruct, underground service drops or <br />connections for every telephone, electric, cable television or similar utility or communication <br />service to buildings in accordance with the standards and other provisions of this Chapter.
