<br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99 - 101 <br />BY: MAYOR NORMAN MUSIAL <br />AN ORDINANCE ALLOWING THE DIRECTOR OF PUBLIC <br />SERVICE TO SELL SURPLIIS PERSONAL COMPUTER <br />EQUIPMENT TO CITYEMPLOYEES OR CITYRESIDENTS, <br />AND DECLARING AN EMERGENCYAS AMENDED. <br />WHEREAS, the City's Department of Public Service now possesses various items of <br />surplus personal computer equipment due to recent purchase of newer equipment; and <br />WHEREAS, the current City laws regarding the sale of surplus personal property by the <br />City, Art. IV, § 13(d), and C.O.N.O. § 955.02(a), do not allow the City to restrict the sale of <br />surplus personal property to City employees or City residents; and <br />WHEREAS, the Council desires to allow the sale of these computers and other <br />equipment to City employees or City residents. <br />NOW, THEREFORE, BE IT ORDAINED BY THIS CITY COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COLINTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: This Council authorizes the Director of Public Service to appraise the <br />value of surplus computers and computer equipment in his control and possession, and post a <br />listing of prices for the purchase of such computers and equipment by City employees or city <br />residents. This Council further authorizes the Director of Public Service to transact sales of such <br />equipment at the appraised prices, and transfer the proceeds thereof to the Director of Finance, <br />for allocation to the City's General Fund. <br />SECTION 2: That all sales are final and computers are sold as is with no implied <br />warranty. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare of City <br />residents, and further provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />
