CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-100 <br />BY: MAYOR NORMAN MUSIAL <br />AN ORDINANCE CREATING NEW CHAPTER 1369 OF THE BUILDING CODE <br />OF THE CITY OF NORTH OLMSTED, ENTITLED "FENCES AND SCREEN <br />WALLS, " FOR THE PURPOSE OF STANDARDIZING FENCE CONSTRUCTION <br />IN THE CITY OF NORTH OLMSTED, PARTICULARLY AS APPLIED TO <br />RESIDENTIAL NEIGHBORHOODS IN ORDER TO PROMOTE GOOD <br />NEIGHBORLY RELATIONS IN NEIGHBORHOODS, AND DECLARING AN <br />EMERGENCY AS AMENDED. <br />WHEREAS, fences are presently permitted in residential and other districts of the City <br />under the applicable provisions of the City's zoning code, but there are presently no provisions <br />within the City's Building Code specifying the types of materials which may be used and the <br />types of fences and workmanship permitted; and <br />WHEREAS, as a result of these deficiencies in the Building Code, some residential <br />property owners have been permitted to construct fences which are aesthetically unattractive <br />and which have offended nearby neighbors by, for example, exposing fence posts and other <br />structural members to the direct view of said nearby neighbors; and <br />WHEREAS, this Council finds that the preservation and promotion of peace and <br />aesthetics in residential areas of the City is in the best interests and promotes the health, safety <br />and morals of the community; and <br />WHEREAS, accordingly, it is the desire of this Council to create a new Chapter in the <br />City's Building Code to provide for standaxdization of the materials used and the types of fence <br />workmanship permitted in residential and other districts of the City; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />
