<br />.4 <br />Resolution No. 99-74 <br />Page 2 <br />WHEREAS, for all these reasons, this Council strongly objects to those provisions of Am. <br />H.B. 101 which would place any limitations upon the authority of municipal corporations to <br />impose conditions relating to project labor upon the successful bidders in public improvement <br />projects; <br />NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Council of the City of North Olmsted strongly opposes Am. H.B. <br />101 which would prohibit public authorities from requiring that successful bidders on public <br />improvement projects adhere to project labor agreements negotiated by the public authority, and <br />would further establish a two-year window of opportunity for "interested" parties to sue public <br />authorities for violations of the Bill's prohibitions, and enable such parties not only to obtain <br />orders from courts of competent jurisdiction voiding public contracts, but also to receive awards <br />of substantial attorney fees, court costs and "other fees" incurred in the course of the law suit. <br />SECTION 2: That the Clerk of this Council is hereby directed to forward an attested <br />copy of this Resolution, immediately upon its passage and approval, to State Senator Robert F. <br />Spada and to Governor Robert Taft. <br />SECTION 3: That this Resolution legislation is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is immediately necessary to transmit this Resolution to the appropriate <br />state officials in Columbus prior to further action being taken on Am. H.B. 101, and further <br />provided it receives the affirmative vote of two-thirds of all members of council, it shall take <br />effect and be in force immediately upon its passage by Council and approval by the Mayor. <br />PASSED: <br />First Reading: <br />Second Reading: <br />Third Reading: <br />Committee: - <br />?4e? <br />
