<br />? <br />CITY OF NORTH OLM5TED <br />RESOLUTION NO. 99-73 <br />BY: COUNCILMAN PAUL MILLER <br />A RESOL UTION SUPPORTING OHIO SENATE BILL 142 (S.B. 142), WHICH <br />WOtILD PROVIDE TOUGHER PENALTIES FOR ASSAULTS UPONLAW <br />ENFORGEMENT OFFICERS, AND DECLARING AN EMERGENCY. <br />WHEREAS, S.B. 142, which is pending in the Judiciary Committee of the Ohio Senate, <br />would require sentencing courts to impose mandatory prison terms on any offender convicted of <br />felonious assault, aggravated assault, or assault when the victim of the offense was a peace officer <br />who suffered serious physical harm as a result of the offense, and would further require that a <br />judge or magistrate, and not a clerk of court, set bail in any case involving a charge of felonious <br />assault, aggravated assault, and assault when the victim of the offense is a police officer; and <br />WHEREAS, this Council believes that individuals who commit assaults upon law <br />enforcement officers should be penalized more severely than individuals who commit assaults <br />upon individuals who are not law enforcement officers; and <br />WHEREAS, for these reasons, this Council strongly supports S.B. 142; <br />NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Council of the City of North Olmsted strongly supports S.B. 142 <br />which would toughen the criminal penalties imposed against individuals who commit assault <br />offenses against law enforcement officers. <br />SECTION 2: That the Clerk of this Council is hereby directed to forward an attested <br />copy of this Resolution, immediately upon its passage and approval, to State Representative Sally <br />Conway Kilbane, State Senator Robert F. Spada, and to Governor Robert Taft. <br />SECTION 3: That this Resolution legislation is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is immediately necessary to transmit this Resolution to the appropriate <br />state officials in Columbus prior to further action being taken on S.B. 142, and further provided <br />it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and <br />be in force immediately upon its passage by Council and approval by the Mayor. <br />
