Ordinance No. 99-67 <br />Page 2 <br />(b) When a treelawn area adjacent to a parcel zoned for and used for other than single-family or <br />two-family use, is subject to a treelawn opening permit, street opening permit, or apron permit in <br />connection with the construction of a new building or an addition to an existing building, <br />restoration shall include brick pavers as directed by the City Engineer. A typical detail plan for <br />such construction using brick pavers is on file in the office of the City Engineer. The limits of <br />brick paver installation shall be as directed by the City Engineer." <br />Be amended, and as amended shall read as follows: <br />"901.07 TREELAWN OPENINGS; PERMIT AND FEE <br />(a) If an application is made for a permit to open a street in the area of the public sidewalk or <br />treelawn, then the applicant shall make the payment of thirty dollars ($30.00) for a permit and <br />shall deposit with the Finance Department thirty dollars ($30.00) per square yard based on the <br />size of the opening, as a guarantee that he will restore the sidewalk or the treelawn to its original <br />condition or pay the City for restoring the same. Such deposit, less the cost of inspection, shall be <br />returned to the person, firm or corporation making the same upon the issuance of a certificate by <br />the City Engineer that the treelawn or sidewalk has been restored to the same or better condition <br />as before the opening was made. <br />(b) When a treelawn area adjacent to a parcel zoned for and used for other that single-family or <br />two-family use, is subject to a treelawn opening permit, street opening permit, or apron permit in <br />connection with the construction or a new building or an addition to an existing building, <br />restoration shall include brick pavers, or concrete simulating brick pavers as approved by the City <br />Engineer. A typical detail plan for such construction using brick pavers is on file in the office of <br />the City engineer. Details for installations other than brick pavers shall be approved by the City <br />Engineer. The limits of brick paver installation and curb replacement shall be as directed by the <br />City Engineer. The color shall be red brick or earthtone colors as approved by the Architectural <br />Review Board." <br />SECTION 2: That any Ordinance, or part of any Ordinance, which is inconsistent with or in <br />conflict with this Ordinance, shall, to the extent of any such inconsistency or conflict, be, and <br />hereby is, repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the preservation of the public health, safety and welfare, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />
