?. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-50 <br />BY: COUNCILMAN GEORGE NASHAR <br />AN ORDINANCE CREATING NEW SECTION 537.19 OF CHAPTER 537 OF THE <br />GENERAL OFFENSES CODE, ENTITLED "OFFENSFS AGAINST PERSONS, " SO AS TO <br />PROHIBIT THE POINTING OF LASER DEVICES AT PERSONS OR ANIMALS, AS <br />AMENDED. <br />WHEREAS, laser pointers, once used only for classroom and business presentations, have <br />now become a popular fad among children; and <br />WHEREAS, according to our police officials, laser pointers are becoming a growing nuisance <br />in the community and nationwide at movie theaters, schools, shopping malls, and other places where <br />crowds axe present; and <br />WHEREAS, laser pointers have become a serious cause for concern a.mong ophthalmologists <br />who say that the retina of the eye can be damaged by looking at a laser beam for more than 10 <br />seconds; and <br />WHEREAS, this Council believes that laser pointers pose a particular danger to children who <br />are more likely than adults to stare into a laser beam, and that a danger is also posed to entertainers <br />and other performers who could be subject to lasers being pointed at their eyes from an audience <br />during a performance; and <br />WHEREAS, the Food and Drug Administration has reported that the light energy from laser <br />pointers is more damaging than staring directly into the sun, and accordingly now requires <br />manufacturers to put a warning on the outside of laser pointer packages against the shining of the <br />beams in eyes; and <br />WHEREAS, the FDA has logged at least two reports of eye injuries and temporary vision <br />problems resulting from the pointers; and <br />WHEREAS, it is accordingly the desire of this Council to prohibit certain uses of laser <br />pointers, and further to prohibit the sale of laser pointers to minors; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and is created new Section 537.19 of Chapter 537 of the General <br />Offenses Code, which, as created, shall read in its entirety as follows: <br />"537.19 LASER POINTERS. <br />(a) As used in this section, the term: <br />
