CITY OF NORTH OLMSTED ORDINANCE NO. 99-42 BY: MICHAEL R. GAREAU JR. AN ORDINANCE ACCEPTING TWO (2) EASEMENTS FOR THE INSTALLATION AND MAINTENANCE OF WATER MAINS FOR THE PURPOSE OF SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO LAND OWNED BY HENNIE HOMES, INC. AND DECLARING AN EMERGENCY. WHEREAS, Hennie Homes, Inc. desires to extend water mains into their property for the Cinnamon Woods Development (Phase 7) and Cinnamon Woods South Phase I & II, and WHEREAS, the City of Cleveland requires that extension of water mains shall only be approved if easements are granted to both the City of Cleveland and the City of North Olmsted in order that water mains may be constructed and maintained therein, and WHEREAS, this Council deems it in the best interest of the City to accept the water main easements described herein; attached Exhibit "B". NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That this Council does hereby accept two (2) easements from Hennie Homes, Inc. for the installation and maintenance of water mains for the purpose of supplying water service by the City of Cleveland, to the property of Hennie Homes, Inc. SECTION 2: That the Clerk of Council is hereby authorized to forward a certified copy of this Ordinance to the Director of Public LJtilities of the City of Cleveland. SECTION 3: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council, and its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
