r <br />I <br />3) The Chairman of the Commission shall appoint member(s) to prepare a <br />documented report on the nominated district including a histor_y, site maps, and eventual <br />placement of plaques. <br />4) The complete report shall be presented to the Commission. <br />5) The Commission shall advise the City Planning Commission of the <br />nomination and request a written statement concerning its recommendation as it relates to the <br />master plan of the City. <br />6) The Commission shall, by certified mail, return receipt requested, to the <br />most recent county tax record addresses, inform all property owners in the proposed district, of <br />the fact of the norrunation after Planning Commission review and of the owners' right to appear at <br />a hearing to support or contest the proposed landmark district designation. <br />7} The Commission shall, at a public hearing, receive evidentiary input from <br />property owners on the issue of whether the proposed district should be designated as a <br />landmarks district, thereby subjecting it to the regulations of Chapter 165 of the City's Codified <br />Ordinances. <br />8) Fallowing public hearing, the Commission shall submit to Council its <br />complete report on the nomination, including its recommendations, the City Planning <br />Commission's statement, and the consent, opposition, and other input of the property owners <br />from the public hearing. <br />9) After review of the Commission's report, the statement of the Planning <br />Commission, and the property owners' consent, opposition, or other input, Council may designate <br />by ordinance the nominated district as an official City Landmarks District. If so approved, the <br />Commission shall thereafter notify the City Building Commissioner, the City Planning <br />Commission, and all property owners within the new Landmarks District, of the designation of the <br />District. The owners shall be so notified by certified mail of the official Council action <br />designating the Landmarks District. Council's decision may be appealed by any owner, the City, <br />or by any other interested party, to the Court of Common Pleas pursuant to Chapter 2506 of the <br />Ohio Revised Code. <br />10) Thereafter, the City shall place official Landmarks District plaques at <br />appropriate locations of the public right of way near all entranceways to the new District and the <br />Commission shall recognize the new district as a Landmarks District of the City subject to the <br />provisions of this Chapter of the Codified Ordinances of the City. <br />165.07 PROCEDURE FOR AUTHORIZATION OF CONSTRUCTION, <br />DEMOLITION, OR OTHER ALTERATION. <br />a) Review of building permit. An application made to the City for a building permit <br />(including a demolition permit) for any of the following acts shall be subject to the provisions of <br />this Chapter: <br />1) Alteration or reconstruction of, or addition to, the exterior of any <br />improvement which constitutes all or part of a designated Landmark; <br />2) Demolition of any improvement which constitutes all or part of a <br />designated Landmark; <br />3) Alteration or reconstruction of, or addition to, the exterior of any <br />improvement which constitutes all or part of a building or structure which has not been designated <br />as a landmark, but is located in a Landmark District; <br />4) Demolition of any improvement which constitutes all or part of a building <br />or structure which has not been designated as a landmark, but is located in a Landmark District; <br />8 <br />..,, P .. , r. .._
