<br />4 <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-30 <br />BY: Mayor Norman T. Musial <br />AN ORDINANCE ESTABLISHING AN ACCOUNT IN THE <br />WASTEWATER TREATMENT PLANT FUND OF THE CITY OF <br />NORTH OLMSTED FOR THE PURPOSE OF IMPROVING THE CITY'S <br />SANITARY SEWER SYSTEM BY CONSTRUCTING AND <br />RECONSTRUCTING STORM 5EWERS AND OTHER STORM WATER <br />DRAINAGE FACILITIES AND IMPROVEMENTS TO CONTROL AND <br />LIMIT THE VOLUME OF STORM WATER ENTERING OR <br />OTHERWISE AFFECTING THE SANITARY SEWERAGE SYSTEM <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted desires to make certain storm sewer <br />improvements in the City which will ameliorate existing sanitary sewer problems; and <br />WHEREAS, the City of North Olmsted desires to pay for these storm sewer <br />improvements with Wastewater Treatment Plant funds; and <br />WHEREAS, it is necessary to establish a separate account in the Wastewater Treatment <br />Plant fund to account for expenditures made for these storm sewer improvements. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there is hereby established an account in the Wastewater Treatment <br />Plant fund of the City of North Olmsted for the purpose of improving the City's sanitary sewer <br />system by constructing and reconstructing storm sewers and other storm water drainage facilities <br />and improvements to control and limit the volume of storm water entering or otherwise affecting <br />the sanitary sewerage system. Said account shall provide for engineering services, equipment <br />rental, materials and supplies for various storm water drainage improvements. Improvements to <br />be constructed include the McKenzie Road culvert improvement, the South Barton Ditch <br />improvements, Root Ditch improvements at Revere Drive, drainage improvements in the <br />Canterbury Woods Subdivision on the Limpert Ditch, and the Gregory Ditch, the North Barton <br />Ditch improvements, and the Lansing Ditch improvements. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to establish this account to enable funds to be <br />spent for these critical improvements to the storm sewer system, which will, in turn, improve the <br />sanitary sewer system, and further provided that it receives the affirmative vote of two-thirds of <br />all members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />
