4 CITY OF NORTH OLMSTED ORDINANCE NO. 99-30 BY: Mayor Norman T. Musial AN ORDINANCE ESTABLISHING AN ACCOUNT IN THE WASTEWATER TREATMENT PLANT FUND OF THE CITY OF NORTH OLMSTED FOR THE PURPOSE OF IMPROVING THE CITY'S SANITARY SEWER SYSTEM BY CONSTRUCTING AND RECONSTRUCTING STORM 5EWERS AND OTHER STORM WATER DRAINAGE FACILITIES AND IMPROVEMENTS TO CONTROL AND LIMIT THE VOLUME OF STORM WATER ENTERING OR OTHERWISE AFFECTING THE SANITARY SEWERAGE SYSTEM AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted desires to make certain storm sewer improvements in the City which will ameliorate existing sanitary sewer problems; and WHEREAS, the City of North Olmsted desires to pay for these storm sewer improvements with Wastewater Treatment Plant funds; and WHEREAS, it is necessary to establish a separate account in the Wastewater Treatment Plant fund to account for expenditures made for these storm sewer improvements. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That there is hereby established an account in the Wastewater Treatment Plant fund of the City of North Olmsted for the purpose of improving the City's sanitary sewer system by constructing and reconstructing storm sewers and other storm water drainage facilities and improvements to control and limit the volume of storm water entering or otherwise affecting the sanitary sewerage system. Said account shall provide for engineering services, equipment rental, materials and supplies for various storm water drainage improvements. Improvements to be constructed include the McKenzie Road culvert improvement, the South Barton Ditch improvements, Root Ditch improvements at Revere Drive, drainage improvements in the Canterbury Woods Subdivision on the Limpert Ditch, and the Gregory Ditch, the North Barton Ditch improvements, and the Lansing Ditch improvements. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to establish this account to enable funds to be spent for these critical improvements to the storm sewer system, which will, in turn, improve the sanitary sewer system, and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
