CITY OF NORTH OLMSTED <br />RESOLUTION NO. 99-17 <br />BY: COIINCII,MAN O'GRADY <br />A RESOL UTION OPPOSING HO USE BILL 702 REGARDING CHANGING <br />THE AMOUNT OF FINES, PENALTIES AND FORFEITED BAIL MONEYS <br />DISTRIBUTED BY VARIOUS CO(JRTS TO COUN7YLAW LIBRARY <br />ASSOCIATIDNS. <br />WHEREAS, Representative Womer Benjamin has introduced House Bill 702 to change <br />the amount of fines, penalties and forfeited bail moneys distributed by various courts to county <br />law library associations; and <br />WHEREAS, House Bill 702 would require the clerk of a municipal court to pay the <br />greater of the two following amounts: A) 25% of the fines and penalties collected and moneys <br />arising from forfeited bail in state cases and "equivalent municipal ordinance cases," or B) the <br />remaining 75% less the amount of the compensation of the clerk, the judges of the municipal <br />court and, if applicable, the county prosecuting attorney for prosecuting state cases in the <br />municipal court; and <br />WHEREAS, House Bill 702 changes the funding formula for county law libraries, setting <br />or increasing maximum amounts to be paid to the law libraries, and adding an inflation adjustment <br />for maximum amounts based on the Consumer Price Index (CPI); and <br />WHEREAS, the proposed maximum amounts to be paid to the law libraries under this <br />bill reflect an increase of nearly five hundred percent (500%) in funding; and <br />WHEREAS, this Council strongly objects to this excessive increase in funding at the <br />expense of municipalities; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />Section 1 The Council of the City of North Olmsted strongly opposes House Bill 702 <br />which changes the amount of fines, penalties and forfeited bail moneys distributed by courts to <br />county law libraries. <br />Section Z The Clerk is hereby directed to forward a copy of this Resolution, <br />immediately upon its passage and approval, to State Representative Sally Conway Kilbane and <br />State Senator Robert Spada. <br />
