? <br />CITY OF NOR"TH OLMSTED <br />ORDINANCE NO. 99-3 <br />BY: Councilman Nashar <br />AN ORDINANCE AMENDING THE TRAFFIC CONTROL FILE <br />OF THE CITY OF NORTH OLMSTED, CONDITIONED DPON <br />THE APPROVAL OF THE DIRECTOR OF THE OHIO <br />DEPARTMENT OF TRANSPORTATION, 50 AS TD PROVIDE <br />FOR A UNIFORM SPEED LIMIT OF 35 MILES PER HOUR ON <br />ALL PORTIONS OF LORAIN ROAD LOCATED WITHIN THE <br />CITY OF NORTH OLMSTED AS AMENDED. <br />WHEREAS, the present posted speed limit on Lorain Road in the City of North Olmsted <br />is 35 mph from the Fairview Park line to Canterbury Road; 25 mph from Canterbury Road to <br />MacKenzie Road; and 35 mph from MacKenzie Road to the Lorain County Line; and <br />WHEREAS, the City's Traffic Engineer, upon review of the matter, has recommended <br />that the speed limit on Lorain Road should be uniformly 35 mph from the Fairview Park line to <br />the Lorain County line, because there would be no significant adverse impact upon traffic safety <br />on Lorain Road as a result, and traffic studies indicated that 35 mph would be an appropriate <br />speed; and <br />WHEREAS, this Council has determined that it is in the best interest of the safety, health <br />and welfare of the residents of the City to provide for a uniform speed limit of 35 mph on Lorain <br />Road from the Fairview Park line to the Lorain County line; and <br />WHEREAS, Lorain Road is a state route; and <br />WHEREAS, pursuant to Ohio R.C. Section 4511.21(B)(2), the prima facie speed limit on <br />state routes located within business districts of municipal corporations is 25 mph; and <br />WHEREAS, Ohio R.C. Section 4511.21 (J) requires that municipal corporations obtain <br />the approval of the Director of the Ohio Department of Transportation, before altering prima-facie <br />speed limits on state routes located within municipal corporations; and <br />WHEREAS, Chapter 305 of the Traffic Code provides for the maintenance of the Traffic <br />Control File, which said file can be amended only by ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTIDN 1: That, based upon the determination of the City's Traffic Engineer that the <br />speed limit along Lorain Road should uniformly be 35 mph, the said Traffic Engineer is hereby <br />
