confirmatorv testing results are negative, all samples shall be destroyed and records of the tesring <br />eYpunged from the Employee's fi1e. <br />317 MEDICAL REVIEW PHYSICIAN <br />The Medical Review Physician shalt be chosen and agreed upon between the Association and the <br />Employer and must be a licensed physician with a knowledge of substance abuse disorders. The <br />Medical Reti7etiv Physician shall be familiaz with the characteristics af drug tests (sensitivity, <br />specificity, and predictive value), the laboratories nanning the tests and the medical conditions aud <br />work exposures of the Empioyees. <br />Tlie role of the medical Revriew Physician will be to review and interpret the positive test results. <br />The Medical Review Physician must examine aliernate medical explanation for any positive test <br />results. This action shalI include conducting a medicai interview with the affected Employee, <br />review of the Eutployee's medical history and review of any other relevaiit biomedical factors. <br />T'he Medical Retiriew Physician must review alI medical reeords made available by the tested <br />Empioyee «lieu a confirmed positive test eould have resulted from legally pxoscribed medication. <br />33.8 LABORATORY RESULTS <br />The labaratory will advise onty the Employee and the Medicat Review Physician of any positive <br />resuits. 't7ie results of a positive drug or alcohol test can only be released to the Employer by the <br />Medical Review Physician once he has completed his review and analysis of the laboratory's test. <br />The Emplo_yer shall only be informed if the individual passed or failed the test. The Empio_ver <br />vvill be reQuired to keep the results confidential and it shall not be released to the general public. <br />33.9 TESTING PROGRAM C4STS <br />The Employer shall pay for all costs involving drug and alcohol testing as weli as the expenses <br />involved of the Medical Re?riew Physician. The Employer shall also reimburse each Employee for <br />their time aitd expense including havel incurred involved 'ni the testing procedure only. <br />33.10 REHABILITATION PROGRAM <br />Any Empiayee who tests positive for illegal drugs or alcohol shall be medically evaluated, <br />counseled and treated for rehabilitation as recommendedby an E.AP. counselor. Employees who <br />complete a rehabilitation pragram will be re-tested randonily once every quarter for flie foliowing <br />rsventv-four months. An Employee may voluntarily enter rehabilitation without a requirement or <br />prior testing. Employees who enter a program on their own initiative shalI not be subject co re- <br />testing. The treatnient and rehabilitation shall be paid for by the Employee's insurance progracn. <br />40 <br />
