<br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to, upon approval of the <br />Board of Control, enter into a contract with Floyd Browne Associates, Inc. ("FBA") providing <br />for consulting engineer services to review the draft NPDES permit submitted to Ohio EPA by the <br />City and to provide further assistance, as needed, to enable the City to obtain a final NPDES <br />permit from Ohio EPA for the operations of the City's Wastewater Treatment Plant, consistent <br />with the proposal attached to this legislation as Exhibit A. Council hereby authorizes the <br />expenditure of funds for this project in an amount not to exceed Twenty-Five Thousand Dollars <br />($25,000.00). <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this Ordinance go into effect immediately because the City <br />must obtain its NPDES permit from Ohio EPA in a tirnety fashion in order to continue to operate <br />the Wastewater Treatment Plant which serves all of the property owners of the City, as well as <br />portions of Fairview Park and Olmsted Township, and further provided it receives the <br />affirmative vote of two-thirds of all members of Cauncil, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED? - ` <br />?
