NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to, upon approval of the Board of Control, enter into a contract with Floyd Browne Associates, Inc. ("FBA") providing for consulting engineer services to review the draft NPDES permit submitted to Ohio EPA by the City and to provide further assistance, as needed, to enable the City to obtain a final NPDES permit from Ohio EPA for the operations of the City's Wastewater Treatment Plant, consistent with the proposal attached to this legislation as Exhibit A. Council hereby authorizes the expenditure of funds for this project in an amount not to exceed Twenty-Five Thousand Dollars ($25,000.00). SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is necessary that this Ordinance go into effect immediately because the City must obtain its NPDES permit from Ohio EPA in a tirnety fashion in order to continue to operate the Wastewater Treatment Plant which serves all of the property owners of the City, as well as portions of Fairview Park and Olmsted Township, and further provided it receives the affirmative vote of two-thirds of all members of Cauncil, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
