? <br />? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 -175 <br />By: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SAFETY <br />TO PURCHASE SIX (6) NEW CROWN VICTORIA INTERCEPTOR <br />CRUISERS, AND RELATED POLICE EQUIPMENT, FOR THE NORTH <br />OLMSTED POLICE DEPARTMENT THROUGH THE STATE PURCHASE <br />PROGRAM; FURTHER AUTHORIZING THE MAYOR TO EXECUTE ALL <br />NECESSARY CONTRACT DOCUMENTS; AND DECLARING AN <br />EMERGENCY. <br />R'HEREAS, the North Olmsted Police Department needs to replace six (6) of its present <br />cruisers, because, due to their age and condition, they are no longer suitable for use in police <br />emergencies; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public Safety to <br />purchase the said six (6) new vehicles, and related police equipment, through the State purchase <br />program, as a permitted exception to the competitive bidding procedure that otherwise would be <br />required for such expenditures, and to further authorize the Mayor to execute any necessary <br />contract documents; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Safety be and he is hereby authorized to <br />purchase through the State Purchasing Program, which was established by O.R.C. Section 125.04 <br />and which the City is authorized to participate in pursuant to Ordinance No. 87-6, six (6) new <br />Crown Victoria lnterceptor Cruisers, and the related police equipment for these vehicles, which is <br />a11 described in specifications on file in the Police Department. If necessary to effectuate any such <br />purchase through the State Purchasing Program, the Mayor is hereby authorized to execute any <br />contract and/or other appropriate documents required by the authorized vendor(s) or the State of <br />Ohio. Any such contract(s) executed by the Mayor shall be in a form and substance consistent <br />with the provisions of this Ordinance and approved by the Director of Law. <br />SECTION2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further for <br />the reason that it is necessary that this Ordinance go into effect immediately to insure availability <br />during the order period and so that police department vehicles that are nearing the end of their <br />useful lives can be replaced before they become unreliable and a threat to the safety of the <br />community, and further provided it receives the affirmative vote of two-thirds of a11 members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor.
