?.?. ?t CITY OF NORTH OLMSTED ORDINANCE NO. 2003 - 158 BY: MAYOR NORMAN T. MUSIAL AN ORDIIVANCE ACCEPTING A PERMANENT STORM SEWER EASEMENT LOCATED ON PROPERTY OWNED BY ROBERT E. GILCHRIST, TRUSTEE OF THE MARY E. GILCHRIST REVOCABLE TRIIST, AND DECLARING AN EMERGENCY. WHEREAS, Robert E. Gilchrist, Trustee of the Ma.ry E. Gilchrist Revocable Trust, has offered an easement to the City of North Olmsted for a storm sewer line extending through his property; and R'HEREAS, the landowner has already accommodated the City by consenting to access to the property for the installation and, in fact, this storrn sewer construction has already been completed; and N'HEREAS, it is the desire of this Council, upon the advice and recommendation of the Director of Law and the City Engineer, to accept this easement and to provide for the recording of such conveyance; and NOW, THEREFORE, BE TT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the City of North Olmsted, a storm sewer easement from Robert E. Gilchrist, Trustee of the Mary E. Gilchrist Revocable Trust, the owner of certain real property as further described within the Standard Easement, attached hereto and incorporated herein by reference. SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Records. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage.
