MUSIAL <br />AN ORDIIVANCE ACCEPTING A PERMANENT STORM <br />SEWER EASEMENT LOCATED ON PROPERTY OWNED BY <br />ROBERT E. GILCHRIST, TRUSTEE OF THE MARY E. <br />GILCHRIST REVOCABLE TRIIST, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Robert E. Gilchrist, Trustee of the Ma.ry E. Gilchrist Revocable Trust, <br />has offered an easement to the City of North Olmsted for a storm sewer line extending through his <br />property; and <br />R'HEREAS, the landowner has already accommodated the City by consenting to <br />access to the property for the installation and, in fact, this storrn sewer construction has already been <br />completed; and <br />N'HEREAS, it is the desire of this Council, upon the advice and recommendation of <br />the Director of Law and the City Engineer, to accept this easement and to provide for the recording <br />of such conveyance; and <br />NOW, THEREFORE, BE TT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the City <br />of North Olmsted, a storm sewer easement from Robert E. Gilchrist, Trustee of the Mary E. Gilchrist <br />Revocable Trust, the owner of certain real property as further described within the Standard <br />Easement, attached hereto and incorporated herein by reference. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed <br />to cause said easement to be recorded in the office of the Cuyahoga County Records. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage. <br />
