<br />Ordinance No. 2003-144 <br />Page 5 <br />such consultation services by agreement with the applicant on the <br />terms and the costs thereof. <br />(e) Time for Review. The Planning Commission shall, within sixty days of its first <br />review of a proposal, make its determinations and changes, if any are required, unless this <br />period of time is extended, either with the consent of the applicant or because of delay <br />attributable to the applicant. (Ord. 2003-47. Passed 9-02-03) <br />Shatl be amended and, as amended, shali read as follows: <br />1126.04 REVIEW BY PLANNING COMMISSION. <br />(a) Scope of Review. All applications for building permits which are properly <br />referred to the Planning Commission sha11 be reviewed by the Comrnission for the <br />purpose of making the following determinations only: <br />(4) Whether the proposal will have any significant adverse impact on <br />residential, commercial or other neighbors whose properties abut <br />the property of the applicant; and <br />(5) Whether the proposal will have any significant adverse impact on <br />vehicular or pedestrian safety on the applicant's property, on the <br />property of abutting owners, or within the adjoining right-of-way <br />area; and <br />(6) Whether the proposal will aesthetically have any significant <br />adverse impact upon surrounding properties within the same <br />zoning district. <br />If an application has been improperly referred to Planning Commission by the <br />Building Official, it shail not be reviewed by the Commission and shall be returned to the <br />Building Official for further action pursuant to Section 1126.03 <br />(b) Determination of Significant Adverse Impact. In making the determinations <br />required by subsection (a) hereof, the Planning Commission shall only consider the <br />following items as having potential adverse affect: <br />(4) With respect to impact on residential, commercial or other <br />neighbors: building location and direction, proposed exterior <br />lighting, anticipated noise or odors to be generated by the proposed <br />use, proposed access drives onto side streets; proposed locations <br />for trash receptacles; and proposed parking and loading facilities. <br />(5) With respect to impact on vehicular or pedestrian safety: parking <br />lot, including aisles and parking spaces, location and configuration; <br />locations and dimensions of lot improvements such as bumper <br />guards, curbs, walls and raised andlor covered walkways; location, <br />dimensions, and confi,guration of access drives; and traffic control <br />devices, including signs and tra#?ic lights. <br />(6) With respect to impact aesthetically upon the community: <br />proposed building, parking, signage and landscaping design; colors <br />,x'. .. ..... .. _... . , . ... ... .. .. .. . .... . ..... . . .. . eru?e..... . ...:. ........??,R .. . .. . z,.:+r?rt?nrmsuuw?c...?v?s:a:?.•+?^..?.;tim4sux+0kn+F'?'.:t¢?.y.,,,..-. <br />. . .? . . ..
