CITY OF NORTH OLMSTED ORDINANCE NO. 2003 - 113 BY: Mayor Musial AN ORDINANCE TO APPROVE AND AUTHORIZE THE MAYOR TO ENTER INTO A SETTELEMENT AGREEMENT WITH SALIM SULEIMAN, TOGETHER WITHHIS INSURANCE CARRIER, PROGRESSIVE INSURANCE, TO COMPROMISE A CLAIMAND DECLARING AN EMERGENCY. WHEREAS, on Apri128, 2003 at or near I-480 and Clague Road, Sa1im Suleiman was involved in an automobile accident and damage was incurred to a traffic light control box in the amount of Twelve Thousand Twenty-One and 32/100 ($12,021.32) Dollars; WHEREAS, Salim Suleiman's insurance company, Progressive Insurance, indicated that he is only insured in the amount of Seven Thousand Five Hundred ($7,500.00) Dollars and has offered the City payment of said amount; WHEREAS, Sa1im Suleiman proposes to pay the City of North Olmsted the remaining or balance, in the amount of Four Thousand Five Hundred and Twenty-one Dollars & thirty-two cents ($4,521.32), by and through his execution of a Promissory Note, to compromise and finally settle the claim; and NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor is hereby authorized to enter into a Settlement Agreement with Progressive Insurance in the amount of Seven Thousand Five Hundred ($7,500.00) Dollars and with Salim Suleiman in the amount of Four Thousand Five Hundred and Twenty-one Dollars & thirty-two cents ($4,521.32), in substantially the form as attached hereto as Exhibit A, as full and final settlement for damages that occurred from an automobile accident on April 28, 2003 at or near I-480 and Clague in the amount of Twelve Thousand Twenty-One and 32/100) ($12,021.32) Dollaxs. A copy of the Settlement Agreement, with Full Release of Property Damage Claims, and Promissory Note are attached hereto as Exhibit A and incorporated herein. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the rea.son that it is necessary that this Ordinance go into effect immediately so that the City may obtain a lump sum payment from Progressive for damages to a traffic light control box, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
